Subject: 6 years H & C Pending Application
  Hi Everyone,

I have a H&C application since 2004 and I am still waiting for decision. I am not sure if this will ever come as all the people I know that filed after have received their decision (good or bad).

I have 2 young children and our lives have been hanging on this approval.

I am have a good job and have been with my employer for more than 4 years. I also have a property and car loan. I am concerned that the wait may be negative.

Please advise me if you or someone you know have gone through this before. Or if you have knowledge on how it works. My file had been at the Etobicoke Immigratin office for 6 years now.

Are there any steps I can take to make it quicker and positive?

There is a legal process that asks the federal court to prompt CIC to make a decision on a file within a given time.

For this, you are required to contact your legal counsel.


And to make it a positive decision, you need to demonstrate that if you return to your country of origin, you will face unusual, undeserved, or / and disappropriate hardship.

The good news is that in an Asian community, two parents who applied H & C in 2005 (both failed refugee claimants) became permanent residents at the end of June 2010.

Six years waiting. Do you have a travel document or has CBSA tried to make you removal ready by obtaining a passport? Did the biological father(s) refuse to sign for you t0 obtain a passport for the kids?

If they have no method of removing you or your children there will be no PRRA and no decision on H&C.

Why would you want to force a decision especially now when the changes to H&C reduces the chances of success????

I understand that your frustrated due to the wait etc. but NO ONE can recommend anything until they have time to read your H&C submissions after knowing about all the details of your case.

Everyone must understand that H&C is based on common sense. Another Counsel can sometimes improve your chances. Especially if the first Counsel tried to re-try your failed refugee claim.

If your Chinese your chances of success are still great but the approval depends on all the little details.

You are very correct. I am currently reporting by phone every month. They called me to the CBSA last year to complete an application for Passports for me and one of my kids. They refused to fill out a form for my Canadian daughter.
Their father is not in Canada but I have their full custody.

I believe they are still working on my passport, but its a year ago. Do you think its wise to call the CBSA?

Its fraustrating as I cannot attend any post graduate programs in school without paying as an iternational student and so many other things.

Anyway Roy, thanks for reading and allowing me to vent my fraustrations.

We also applied in 2004 under H & C and we are still waiting for the result. we also call CBSA every month and about three years ago we filled the application for our passport renewal. Local CIC office said that our file is with CBSA because due to risk factor in our application, CBDSA will handle our case. We are in Canada since 99 and we renew our work permits every year and pay the fees everytime. but last year CIC send the refund cheque with a letter that our application has been approved under some condition and there is no need to pay the work permit renewal fee. I called CIC and asked them about this letter, the lady said that she has no information about the letter. She said just wait, may be the officer will send another letter with details.

I´m also H&C applicant. When I called CIC after I received the letter that my file has been transferred from Vegreville, I was told it would take 36months to make final decision. So, ya, I´m in waiting period. I wish cic find a way to process file faster cuz making us wait for the result that can either be bad or good for such a long time, feel like wasting applicant´s time.

You are very right, its a long wait and could be fraustrating. My file was transfered in June of 2004 and I am still waiting.

Thanks for sharing your experience though. Its good to know that I am not alone!!!
