  Please could someone help me..!!

Iam Currently a visitor in Canada and i will be heading back to uk soon. as the visa extension failed. i have a clean record but because of the olypmics my visa extension was delayed by 3 months. so i have to leave in august as i have been here over my 6 months but i retained a lawyer here in canada to keep me legal as i wait for immigration to reply back to me.

Anyways, i have been here visiting my GF and i really love the country.. as i have to go back soon my question is that if she came to the UK to marry me :

* will she need a specific visa?
*if she is currently sponsoring someone (this someone left her for 2 years now and obtained a PR) but has not signed any marriage papers with him? after we get married in uk will she have problems sponsoring me over to canada.? what will the problems be?

ive heard that if she marries me in canada she will have problems even marrying a british citizen? is that true.

Alan, the problem is that she cannot marry you in the UK. UK immigration rules prevent foreigners from coming to the UK to get married, unless they applied for and obtained a marriage visa prior to coming to the UK. You need to research more on this.

First of all you have to go back to UK ASAP before you get caught and deported. Deportation will complicate things for you. but do not panic. If you leave Canada silently, no one will check your over staying.

She can definitely get married to you in UK. But you need to apply for a license of marriage and you both need to have a known address with proof of bills etc etc. This can take up to 6 weeks. I believe you have your place there in UK. The new marriage regulations in UK were introduced to prevent the abuse of the system, and to stop the business of marriage of convenience.

Your post is somehow confusing in some points. She sponsored someone without signing marriage papers!! I did not get that. In anyway, she can NOT sponsor you before the expiry of the 3 years (undertake) commitment to her first sponsorship. Also if the Sponsored person claimed social assitance then she has obligation to pay back to Canada governmnet before any new sponsorship. Also, for her to sponsor two person in a short period may put the new sponsorship application under the microscope of immigration

dont worry im not being deported and immigration know of this case.lol

I know that she applied for a Common law Sponsor in 2006 and the application was finished in 2007 July, but the guy left after the green card arrived and dumped her. we met in 2008 until now, she has come to UK a couple of times.

does she have to wait 5 years to finish the sponsorship? because she wanted to terminate the sponsorship after the guy left but immigration said they couldnt do anything. is immigration lying or is that how it works?

how can she obtain for a marriage visa if we have not lived for 2 years?

nono..she doesnt owe the government anything apart from her student loan and monthly MSP. so she is good on that part.

Alan... read the CIC website. Sponsorship contracts with CIC are for 3 years after landing (not 5. Canada does not have green cards. She is not eligible to sponsor you in any way until 3 years after he landed.

If you live common law for a year, she can sponsor, or if you are married, there is no waiting period.

HOWEVER, they will look very carefully at your relationship as she has already sponsored someone previously.

If immigration know about your overstaying then it is safe to leave Canada ASAP. You also need to provide evidenc and prrof that you left the country.

I believe she is now ok with (undertake)commitment. It is only for 3 years and it seems that the expiry date is over.

She reported the guy to immigration. Immigration were correct in that they could not do anything about the guy. But she all the surrounding circumstances will float out when you apply for your sponsorship. You just need to make it a solid relationship, not just for convenience, like the other guy did.

how can she obtain for a marriage visa if we have not lived for 2 years? Sorry I didn´t get your question here. Do you mean visa to UK or in Canada? Is she a Canadian citizen?

Hi,
im from London.yes visa to UK..!! she is Canadian citizen.

how can i get her to come to uk to live for 2 years without her working? and having gas utiliies etc in her name our our name?
we will ask her previous lawyer again as everybody says 5 years and you all say 3 years.
so do you think its better for her to come to uk somehow and on what Visa? and will the process be quicker for us?? would it be easier that way?

tell the lawyer to check out www.cic.gc.ca Lawyers are not automatically trained in immigration law. Hopefully, her divorce is final - that is the only other hitch (no pun intended)

all these websites are very confusingi would like to ask a question.i have a fiance who i actually met online and we have been with each other for 2 year.she has been over to the uk and im looking at going over to canada for 3 month with a view to getting married as soon as possible and staying in canada.could anyone give me any correct information on the best way of going about this.i have spoke to the commonwealth state but even thats confusing..thank you
