Subject: Will my husband have to return to his country
  My husband and I got married this year in new york while he was visiting ny on a B2 visa. He overstayed and is currently still in ny. I would like to sponsor him to live in Canada with me but my question is wll he have to return to his country in order to process his application or can he remain in NY. Also will it be less likely that they give him residency here in Canada since he overstayed his B2 visa.

Since he is not a resident of the US and has no status in the US you will have to apply outland through his home country.
If he stays in the US and gets deported it will cause problems for you,if he can not get his status in the US valid,he should leave go home and wait there for his approval.Dont cause yourself grief that can be avoided.
If you want this to go smooth do the right things if you want to take a chance that is up to you.

Great forum that I´ve stumbled on this evening. I too am in a similar but slight distinct situation. I was advised by my attorney that my would have to process the paper work from outside the US. Your husband will most like face a 10 year ban from the US.

One question I wanted to find out was is it possible to submit the application to serve as a sponsor before our spouse have to leave the US?
