Subject: Immigration with Warrants
  There are two bench warrants: 1. Aggravated Assualt 2.Failure To Appear, both these warrants are from 2002 so it has been quite a few years since the crime allegedly commited. Warrants are U.S. extraditable only.

I was wondering if I could get Residency on deemed rehabilitated (considering so much time has passed since crime commited) / rehabilitation (since I work for a reputable company and had spotless record since 2002) / or TRP (they can allow me and see if I can be of any danger to anyone and than grant permanent residency) basis. Now these warrants are in the United States where I cant return since I do not have valid U.S. visa anymore, and I am seeking residency through sponsorship of my wife. I have a wife and 2 kids who are all canadian born citizens.

what could be my options?

Not a hope in hell. You cannot be deemed rehabilitated. You are fugitive at this point in time.

This is how it may work for you:

1- You turn yourself in
2- Go to the can
3- Get out of the can and then CBP deports you

FROM your home country then you may start thinking about the "how" can you be deemed rehabilitated and then ONLY then you may start planning on immigrating to Canada.

Right now you are looking for a place to hide and not to face the justice.

Let me tell you what.....Drive up to the Canadian border and try to enter Canada and let me know how it goes for you.

I do not have a visa to be readmited in the U.S. so how can I goto that can?

An individual is deemed rehabilitated if:

. 10 years have expired from the last day of their sentence or the date of the offence;

. no conviction or imprisonnement has been completed since the prior offence;

. the offence was punishable in Canada for a term less than 10 years;

I took this down off canadian immigration website, any opinions?

day of the sentence - it means 10 years from the date you finish your time in jail - not one day sooner.

"or the date of the offense" whichever is LATER.
You are inadmissable for LIFE, you can never be "deemed" because you have TWO offenses which are both equal to indictable offenses in Canada. You will need to apply for "criminal Rehabilitation" at a Canadian Consulate outside of Canada. You will only be able to do this after five years has passed from the end of the completion of the SENTENCE. Since you have a warrant and have not been sentenced....you have a long time to wait.

is it that I am in denial or you guys don`t seem to understand law, a simplest word added or subtracted can change the whole scenerio, now I know that it will be an up-hill battle but again the terminology used "or the date of the offence" is prettty compelling....

By the way if I may, what makes you JP and Sharon so sure of the final verdicts? are you guys attornies? cuz if you were you wouldnt be saying what you are, and if you are judges I am sure you are probably running a very f***** up town as I highly believe you guys re in deniyal...

An aggravtted assualt could be a punch leaving a black eye, and now if that punch was inflicted on someone well connected then ofcourse they would have formulated such charges that I may be damned forever, but I THINK I WILL BE ABLE TO PROVE THEM AND YOU BOTH WRONG...

and thats not my wish thats my will...
