Subject: Sponsoring my wife to Canada
  Before we got married, my wife worked in the Middle East for 2 years. I told her to please get a police clearance before coming home to Philippines for our marriage. Unfortunately, she did not remember to get the police clearance and we were unable to get the police clearance via post from the police headquaters in that country. So we got her a new passport in her new name, and applied for the spousal sponsorship without declaring she worked and lived in the Middle East for 2 yrs. During her interview, the visa officer shocked her.....she said "we have information that you worked as a sales girl in the Middle East". My wife was shocked, because they knew the type of job she did and even the particular country in the Middle East she worked in. She vehemently denied the claim. The next question was "is this your first passport"? My wife said yes, and the interviewer said she is not convinced at her answer. Next was "what phone number did you use to communicate with your husband prior to marriage"? My wife gave them her Philippines cell number, but the interviewer refused the number saying its an incorrect number. So to cut the story short, the embassy told her they would check with the Philippines government records (Passport office and immigration), and if they find out she has indeed worked outside Philippines, her application will be denied, but if she hasn´t left the country before, her application will be accepted. Its been a month now since she interviewed and we have not gotten any response back from the embassy. What can we do??? Can a self confession at the embassy help at this moment? Has anyone been in a similar situation before? If so, what did you do?

That comment started with a very lame excuse.

Maybe this would be a good time to learn not to lie. If you were unable to obtain a police record you should have told the embassy about it and they would have tell you what and how to do it and sometimes they will requested themselfs.

You choose to lie and the officer knows it, the only few things that the officer needs to know are her place and date of birth along with her name and the rest is history.

What they are doing right now is doing what CIC calls "data verification".
She is going to get excluded and her application is going to be refused, you can rest assured of that.

A self confession? what do you think this is? a gang show?

No! forget it! you are done! Come back in two years with the truth and maybe for once you will be able to start doing things the right way.

You have posted this same question to multiple immmigration message boards today. You are going to get the same answer no matter where you go because there is only one answer.

Your wife lied several times and this is not treated lightly. Thanks to her lies, she´s qualified herself for a two year ban. After the two year ban passes, you can apply again, but be prepared for your application to be scruitinized very very closely and take far longer to process than normal.

Both of you made a very very big error in deciding to misrepresent her past.

Dear DocD right to the point, good one.

You Jay have two concerns IRPA A40 for misrepresentation as well IRPA 16 for telling a lie.

A school in our area has a poster outside the Principal´s Office that says "Always tell the truth because then you do not have to remember what you said".

A16 look it up Jay oh okay Jay here it is;

16. (1) A person who makes an application must answer truthfully all questions put to them for the purpose of the examination and must produce a visa and all relevant evidence and documents that the officer reasonably requires.

Now when a couple decides to deceive it starts slow then the Sponsor has to say this because of the misrepresentation the applicant gave to a question.

Lets look at the Sponsors questionnaire,

* First Contact was were?
* Met in Person where?
etc.

Now it appears from your posting that the Visa post got information (poisen pen letter) that your wife misrepresented A40

40. (1) A permanent resident or a foreign national is inadmissible for misrepresentation
(a) for directly or indirectly misrepresenting or withholding material facts relating to a relevant matter that induces or could induce an error in the administration of this Act;

You or your wife opened your mouth and told others what you were going to do that was wrong. Somebody wanted VENGENCE and you need to ask why?

Now what really surprises me is Anonymous 166.15.229 comment that you have posted the same comment on multiple multiple message boards.

Anonymous 166.15.229 is really surfing the internet and replied to your posting here and maybe eleswhere. I wonder if this is a Senior Member of another forum who was found inadmissable to Canada because she put down wrong information as to her son (who was not a dependent) so she was found inadmissable to Canada? Robsluv is this the pot calling the kettle black?

We all make mistakes and getting a Police Clearances from certain countries is impossible if your not residing legally in that country.

It would of been better to tell the truth because in her passport would have been a stamp showing that she had a work permit in that particular middle east country.

Jay you do not have to wait two years like Anonymous 166.15.229 claims you can apply again and seek relief for your inadmissability but the odds of getting the appropriate approval is about the same as me winning the Lotto Max 15 Million tonight.

Multiple Forums Anonymous 166.15.229 and people here say to me get a life.

Hi Roy,

No - I´m not Robsluv (although I´m somewhat familiar with her story). I´m a Canadian sponsoring an American husband (no dependents on either side). Our "complication" is that my husband has spent a fair amount of his life working as an expat overseas in Africa and the Middle East (he was born in the US). So I´ve mentally prepared myself for a long background check and longer application processing time.

Good call on seeking releif. As you said - it´s a long shot. But I suppose everything may be worth a try in these situations...

People including Visa Officers do stupid things and they have heard of most silly mistakes before time and again. Jay can apply for a TRV and it is possible but unlikely.

The explanation for this type of situation has to be real good.

Not really Roy, a mistake would have been "forgot" to mentioned it when filling the forms, she denied during the interview. How much would you like to bet (or lose) that she is going to be charge for misrepresentation and banned for two years?

A TRV? for what? To enter Canada and apply from within?
yeah!.... that´s a plan.

There is no need to lie on something like that unless........ a person is covering something.

Under that train of thought this lady has already been flagged and her background investigation is going to take FOREVER. Assuming that she will try to re-apply in the future.

No free lunch here she is done.

The information is readily available everywhere that no PCC are issued unless your in status she Lied you´re right 99.9% of the time but there are at least one understanding Visa officer in every Visa Post. EXCEPT Hong Kong
