Subject: spousal sponsorship within CANADA
  hi..im a filipino contract worker.i came here in sept 2008&worked as a receptionist.i resigned&got another work permit in DQ.i got married to a canadian nov.09. we submitted our spousal sponsorship within canada in april 2010 along with application for open work permit.my questions are,when will i receive an open work permit, how long is the spousal application and what will happen to me when my work permit in DQ expires in feb 2011? thanks guys!

You will receive your open work permit within 6 months of applying, as long as you are still a legal residence of Canada 6 months after you applied. The inland PR takes about 2 yrs to process. It would be much faster if you had applied thru´ Manila.

You will never receive a work permit in six months UNLESS within that time frame your approved stage one. Then you need to apply for a work permit.

Submitting a Spousal Sponsorship to Vegreville with an application for a work permit at the same time is rather aggressive! Since the work permit application is to be submitted to a separate location only AFTER stage one approval.

Expecting a busy CIC employee to send your WP application to another department in the same complex is like asking others to do work you should have done yourself.

Now to receive the Open Work Permit you DO NOT NEED TO BE LEGAL! Many people who have been here for years illegally get married and are approved because they are in a genuine relationship. That is Public Policy please read the Inland Processing Manuals IP*

sending both application and work permit application was the CIC customer service rep´s advice. so you mean, before my work permits expires in feb 2011, i will receive my open work permit already?

You can submit your application for Permanent Residency in either your country of origin or residence. To submit in your country of residence, you mist have resided in that country legally for atleast 1 yr. I advise that you phone CIC on 1-888-242-2100 for a more up-to-date info on your situation. Last time I called, they said you will automatically get a work permit if you are legally married to a Canadian citizen and file in for your PR within Canada. Don´t know if this has changed or not.

i am in canada here uder a work permit for two years now.. my work permit will expire feb 2011. i submitted by spousal sponsorship application and open work permit request in one envelope and mailed them vergreville

You should be ok even if your current work permit expires, as long as you have a file-in-progress with CIC, you will be considered legal until CIC decides on your case. If CIC turns down your PR application, you must then leave Canada within 30 days or so.

Wrong Jay should inform him/her self a little better before advising someone else!

You may only apply for a work permit within Canada until you are approved in the "first stage" then you apply for it. IN A DIFFERENT OFFICE!

Well, I said as at the last time I phoned, thats what I was told. And I gave a phone number for them to call and hear from a qualified immigration officer themself
