Subject: help need some information
  Hope someone can help me. I am a canadian citizen living in Scotland. I am looking to go back to canada and live with my scottish husband and 2 children aged 8 and 10. Now I know that I won´t have a problem going over, but I have been on many forums and I get quite confused about how to do this. On the immigration sites, I can´t actually speak to anyone as they are all computerised. Here goes. My husband hasn´t applied as yet as we are not sure if he would get accepted as he has a pre excisting illness, it doesn´t stop him from working, but it means an expensive injection every month and a scan every year. How easy would it be for me to sponser him, does that take longer that applying for canadian citizenship???. I had thought of him coming over and looking after the children while I work but he would need medical cover which he won´t get.

I´m sorry that this is a bit of a mess, but I hope someone with some patience and understanding can take their time to help me.

Hi Joanne, since you are a Canadian citizen, your kids are citizen as well. You need to visit the CHC in London and get a Proof of citizenship kit, complete it with your kids birth certificate as well as your own proof of Canadian citizenship (but remember a Canadian passport is not a proof of Canadian Citizenship, so you MUST include a proper proof of citizenship) and submit to the embassy. It could take as much as a year for your kids to get their citizenship certificate and be eligible to apply for Canadian passports. But in the case of your husband, depending on the nature of his illness, he could be found medically inadmissible to Canada. But all is not lost. You have to come to Canada, get a lawyer to appeal the decision on compassionate or humanitarian ground. It could be a lenghty battle which could take as much as 1-2 yrs to complete.

To be able to sponsor him, you must show proof that you plan to move to Canada once he becomes a landed immigrant. You may need offer of employment from Canada, or letters from relative confirming your intentions to move back home.

You cannot apply for Canadian citizenship for your husband, ´cos he is NOT eligible. Only your kids are. You must sponsor him for permanent residency first, and then after 3 years of continously residing in Canada, he can file in for his citizenship.

Since your case is a very technical and sensitive one, I would advise you ask your relatives in Canada to get you a lawyer who can file your application and do follow-up since there is a high chance he will be declined. A typical immigration lawyer in any big city will charge as much as $3500 to file in your sponsorship application on your behalf. You can chose to file the application yourself, but you will most likely need a lawyer if you have to appeal the decision should it not favour you.

Hire a Lawyer LOL

Now if the innitial advice was hire an Immigration Lawyer that would be a little different.

Hire a Immigration Lawyer in the province of Ontario that the LSUC denotes as a specialist and multiply Conrad estimate by ten, LOL

Common sense if his illness makes him medically inadmissable he is medically inadmissable, PERIOD!

I suggest go to any Designated Medical Practitioner and pay him to assess your husbands medical condition and ask him if your spouse is medically inadmissable?

Appealing a refusal based on medically inadmissability is like picking the winning lottery ticket.

Down Load VEOH and google my name and IAD Appeal Seminar 3/4 of the way through IAD Member MacLean explains your chances of success based on Conrad advice. Conrad´s link did not work for me.

No one can give this advice based on this posting.

Thank you both for replying,they were both realy helpful. I thought Conrads reply was great and realy appreciated, I think its a shame that you were very harsh about conrads reply, as he chose to try and help me with my thread and took time out of his day, as did you. Thank you both. Joanne

When you show compassion for Conrad that is good but is it common sense?

Advice has to be based on logic.

When one is ill and you claim your partner needs expensive medical attention yearly and Conrad gives that advice anyone should reasonably expect the same reaction.
