Subject: Marriage S' Ship if entered Canada without a Visa
  Hi all,

I came to the U.S. on a visa, overstayed and am currently out of status. My girlfriend who I met at work here is a Canadian citizen. If I some how manage to sneek across into Canada and marry her once there, can she file for spousal sponsorship within Canada ? The trouble is I cannot marry her in the US cause if she were to file our papers in Canada, I would have to return to my home country for the interview. For some reason if it is denied, that seperates us even further considering the distance between Canada & India.

Like no other man had to sacrifice something to be with his partner.

Grow up be a man. If she is worth it you will do what is right. Either way your going to have to tell the truth on your application.

Hi Roy,

Thanks for the response but you seem upset answering my question. I understand sometimes these questions look silly but it is what it is for me.

The reason I asked was because the US does not allow sponsorship of a spouse if one entered the country without a visa. The 10 year bar and application process has to be done from ones home country.

I just asked out of curiosity and am not trying to be sneaky about anything. I will tell the truth on my application anyways but why even consider something if it is not possible. I was here on a H1 and the GC process is snails pace.

No offence intended and I am not trying to be dis-respectful either by writing back.

I am quite sure you are reading too much into Roy´s words! He did not imply any suspicion or derision. Regarding the illegal entry into Canada and all that jazz, I am not sure is a good idea.

Thanks for responding. I do understand it is not a good idea but the thought does cross ones mind. It is so very strange that responses are most vague like it´s a matter of rollin´ the dice.

I had a straight question and couldn´t get an appropriate answer. I didn´t ask if it were wrong or right, instead, just if it were possible or not for a spouse to file for his/her partner who might have entered without a visa. Final decisions lie with us.

what is the problem with getting married, going home and her applying for your sponsorship? Thousands do it every year and survive the ordeal.

With all my respect to all out here. It might be a deal and that is why I was hesitant. Thousands of people might do it but I don´t wanna risk it here since there might be an amnesty deal coming up soon in the US. These paper work issues take forever especially in India which has such a huge population.

Anyways thanks all for trying to answer my question.

an outland application in India (New Delhi) are 4-6 months.

Playing by the rules does not come easy for you, does it? A better way, faster way for why... because you think you are better than everyone else or that you are special?

Your wife can sponsor you- even if you are out of status. There is no guarantee that you would be called for an interview - that depends on how well you prove your case.

As a Canadian citizen (not PR), she would be eligible to file sponsorship papers from the US as long as she can verify she is moving back to Canada.

However, you have to resolve your personal status - you can either prove beyond a doubt that you have been living common law for more than a year or you are married. A consideration... CIC may wonder if you are using your girlfriend to gain legal status in Canada as a default to your current situation in the US. I would not hold my breath on the Amnesty deal...

Well Sharon, sorry if I pissed off any of you on here. I definitely like playing by the rules and considering that, I don´t want to make another wrong move to correct my overstay. I just thought it is better to ask rather than to assume and who wouldn´t like the easiest quickest way ? I don´t think I am more special than anyone eles who applies but at the same time I´ve gotta worry about my own situation and the time involved.
