Subject: immigration matter
  I try to sponsor my wife and children three years ago and was denied by the Hong Kong visa officer overseas, and the case wasin appeal in the court for over a year now.
Currently My doctor adivise me that I need to undergo a open heart surgery which require my family member to be here during and after the surgery, which they refused because the case on the appeal, isn´t it is two seperate case. I just need a compassive temp visa for her along to visit me so I can finish my surgery, then she can go back home to wait for the result of the appeal, its a matter of urgently, so what can I do now?

First why is your appeal taking so long??? Which IAD Office???

I suggest contact your Counsel and get him/her to assist using absolutely everything in their arsenal to get your partner here.

The IAD office in Vancouver.
I already tried everybody that can help me including my lawyer, also wrote letters to MP, also prime minister Stephen Harber, Minister Jason Kennedy, even American president Obama, and the MP in Hong Kong too. Who else can I contact now??I tried everybody with no reply.

My MP told me to let her to apply in the visa office, but I know for sure the visa office overseas they don´t let her to have a visa because of the appeal stage.

You need to ascertain why no ADR alternate dispute resolution was offered. What was the reaon for refusal? A40, Regulation 4 or A16, etc.

You two made mistakes on your application. If the same Lawyer did the application as your appeal maybe it is time to consider other advisors.

The media might be able to speed things up as well.

My lawyer informed me that no alternate resolution was offer. The reason for the refusal is inadmissible for financial reasons under section 39 of the immigration and refugee protection act.
THe first applcation was by the Canadian overseas immigration consultant, and now the appeal is by the lawyer Kang and co.
What else can we do now so as I can have my surgery asap.
Please help.

Now for your information going to the media is extremely effective, if done well.

Google the Federal Court Decision (Mavis Baker) on the Best Interest of the Child. That is where the H&C Officer clearly wrote. "However, because of the circumstances involved, there is a potential for adverse publicity. I recommend refusal but you may wish to clear this with someone at Region".

That Fed. Court Decision is also notated in the IP5 H&C Manual as well.
