Subject: Failed Refugee
  Hi there,
Can anybody provide me with an answer please.
We are from Georgia.
We claimed refugee in Ireland in 2005 and been refused.In 2007 we moved to Canada and claimed refugee here, once again we have been refused.
We have Canadian born son who is 3 years old.We filed for H&C a year ago. We are going for an interview regarding our PRRA decision.I know it´s going to be 99% negative.The question is:

Can we ask officer to deport us back to Ireland to proceed some how with our claim there?

You have to be removed to a country that you are a national of and you have a right to reside which is Georgia.

CIC is not going to deport you.
CBSA will.

And no, CBSA cannot send you to Ireland. You have no right to enter that country.

That answer was based on a Spousal Sponsorship issue.

So you go to Ireland and make a refugee claim and get denied and then come to Canada and make another refugee claim based on the same reasons you used in Ireland.

Either way you were suppose to tell the IRB you came from Ireland and you made a claim there.

Can you imagine the trouble the Canadian government would get into if they removed all failed refugee claimants to Germany, France, Sweden etc. just to get them out of Canada?

Apply for an ARC and submit an application based on your skills etc. I have brought back failed refugee claimants as temporary residents before and could possibly do you but this forum is not the place to discuss the details.

Now do you have to reside in Georgia when you return. NO so stop being negative you have options.

I mentioned earlier that I have filed the H&C application, if i will appeal to a Federal Courts HOW MUCH TIME WILL I BUY?
I was told by a lawyer that he can(%90) delay my deportation order until the H&C DECISION IS MADE by appealing to the Federal Courts for just $5000.
IS THAT TRUE?
AND IS THERE ANY OTHER OPTION,PROGRAM FOR US TO STAY OR APPLY FROM WITHIN CANADA EXIST?

You filed a H & C a year ago. (vegreville)

You filed a PRRA to a local immigration office in B.C

Your H & C file is transferred to your local office.

A PRRA officer at your local immigration office usually assesses both files (H&C and PRRA) at the same time and makes a decision.

Or

Your H & C file stays stagnant ( no decision made)and a decision is made on the PRRA only and you may be ready to be removed.

and

You may have to file a motion for a stay of removal until a decision is made on the H & C.

And / or you have to file a judicial review.

Still CBSA may do their job.

Please don´t despair over failed app in Canada; dash into the US (it is quite close!) and file a claim there! McCain thinks with Georgia (we are all Georgians!) so he can help. You have to dash to Arizona and directly request him. Assuming they won´t throw him out of Senate in November, you may have a great chance

go and read the 3rd country rules. US will not accept someone that is hopping from country to country trying to find someone that will accept them. Neither will Canada.
