hanks for your reply Roy and everybody else.
I mentioned earlier that I have filed the H&C application, if i will appeal to a Federal Courts HOW MUCH TIME WILL I BUY?
I was told by a lawyer that he can(%90) delay my deportation order until the H&C DECISION IS MADE by appealing to the Federal Courts for just $5000.
IS THAT TRUE?
AND IS THERE ANY OTHER OPTION,PROGRAM FOR US TO STAY OR APPLY FROM WITHIN CANADA EXIST?

Contact this law office in Toronto. If you are low income, they can help you file your case with Federal High Court and get legal aid to pay your legal expenses. Almost no cost to you!!

There is no provision to deferr removal if an H&C is submitted wait for DocD to comment.
If there is clear H&C factors and the H & C has been in for a considerable time maybe.
$5,000.00 for Federal Court Application is a good price normally 6.5 or 7K

The lawyer can still help you for free. You only need to make 2 trips to Toronto- first one to sign the papers and the second for the trial.

Thanks Roy,
But can you tell how long does it normally takes from the time you do you deffer to the actual Federal Courts decision?
I looked up on the site and it shows that they review now the applications for H&C filed before January 2010 ( we filed in November 2009)and it will take them 8-9 months.
Can I buy this much time by appealing to a Federal Courts?
Appreciate your answer.

Okay let us look at this scenario. Person arrived in Canada and then makes a Reugee Claim.
2+ years later receives a negative RPD decision. Sumits an H&C application. 2+ years after submitting H&C gets called for the PRRA and receives a negative PRRA decision.
CBSA Officer says bring in a ticket and go home!
Person says but I applied for H&C and DocD says so you have not been approved stage one so good bye.

What the 5K is probaly doing is going to apply for a deferral of removal then file a Stay application. I hate to inform you I have clients waiting five and more years.
Not a great chance at success, sorry but my opinion due to the recent H&C sumission.

CIC have got great success stories too but the reality is there are more failure /unsuccessful stories than success stories,oh yeah those who could not succeed are all idiots.... somehow no one shows them!!!! Hey Troll name we one Certified Consultant or Immigration Lawyer including Immigration Specialist by the LSUC that has more media Stories written about their successes!
Not articles they write themselves to promote their own firm.
