Subject: wife's sponsorship refusal
  Hello,
I have sponsored my wife, and last week at her interview,the immigration officer told her that she does not believe our relationship is genuine. Our facts are that I am 61,and she is 41. This is my 2nd marriage, her 1st. MY EX wife sponsored my child and me 16 yrs ago, she and I were divorced in 2006, and I remarried in 2007. I sponsored my wife in 2007. Since 2007-2010, I lived in my residence alone. Three months before my wife´s interview, I sold my residence, and I moved in to the old property that my ex wife and I still owns, because the house was half vacant, and I did not want to pay rent when I owned a property of my own. I live in the basement, while my ex wife lives at the top floor. I did not mention to my wife that my ex wife resides at the top floor since she will get upset to hear this. I submitted the change of address to CIC accordingly. When the immigration officer told my wife that ex wife and I ´live together´ she said No, and that I told her that ex wife lives somewhere else. I understand that I did not break any law here, but I need to know when I appeal my case, will it be consented, and that it, indeed is not considered a break of law not to inform my wife about my ex wife´s current residential address. I also need to confirm that there is no rule in our situation that will ban me from appealing.
Please help by responding as soon as possible.

If you have told the truth to your current wife in the first place, she would have been a little bit more prepared for the interview don´t you think?

So, your wife was poorly prepared for a spousal interview and she was rejected. Sure you may appeal it but you should consider getting a professional involved to help you out with the appeal.

Well I will go a little further than DocD.

You DIY (Did It Yourself) by submitting your own spousal sponsorship application. Then you change your address to save money and list a residential/mailing address that is on the forms since you (do not tell Lies) and listed your ex-spouses address on your IMM 5540 Sponsors Questionnaire.

In Canada a couple can live at the same residential address and still be living separate and apart, but......

.....IT SMELLS!

An Appeal is just that a logical explanation/reason why certain information did not come out, properly. Like you where getting tight with money and needed to reach a compromise and didn´t want to stop sending funds to your new wife but needed a way to save for the future.

Get assistance ASAP to have disclosure documents submitted before the DRO reviews your appeal file so he/she will select your appeal for an ADR.

Thank you for your input. I have sent two emails to CIC ever since the interview disclosing our reasons of living in the same residence and the fact that I didn´t tell my current wife this information because she will get upset. Would this informaiton cause any negative impact on the case? It has been a week since the interview, and the website still states that our application is in process. How long will it take before we get the refusal letter, and do we have to wait for the refusal letter before we can get started on the appeal? Would it make any difference in my case appeal if I change my address now to a new place? Do you have suggestions where to find affordable and reliable legal counsel? I am not familiar with the procedure of DRO reviewing appeal case so it may be selected for ADR? Will you please elaborate on it, and what is the expected timeframe for this to happen?

You can get away with one refusal letter when you submit an Spousal Appeal ut not two. Your refusal letter comes by regular mail.

Once registered they inform the Hearings Office to request the "Record" (Forms and Officers Notes) from the Visa Post. That takes aout four months but you can get the notes in six weeks and the whole file in about two months. The notes are the key´s.

Then you have to submit disclosure documents to correct issues and hopefully the IAD person reviewing your file grants an ADR.

Islam is cunning. It is a simple matter! You own half the house your ex-wife owns?? geez man (or should I say Allah man LOL) get a grip. There should be boundaries or limitations to cunningness.... Sorry they got ya! and they got ya good.

There is no cunningness here. I voluntarily submitted all the address information to the Immigration Department!
because there is nothing to hide. Roy, Kindly inform what is the estimated timeframe before we receive the refusal letter since my wife´s interview. It still states in the website that our file is IN PROCESS. Is there a way we may expedite the process? I have already sent 2 emails to CIC ever since my wife´s interview.

No cunning motives here, yeah right!

Someone claiming to be your daughter calls me at night after normal business hours. The person to claiming to be your daughter asks questions after question then books an appointment on a LONG weekend and then you never show.

When you want people to show compassion to you remember it has to be common sense to everyone.
