Subject: Uncaring CBSA Officer
  Last week I was approached by a couple of upset Ladies who were trying to understand why their Niece was not being given a chance to take her children with her.

In fact my client was scheduled for removal on October 22 and her Family Court Custody dispute was scheduled to be heard in Milton Court on October 29th 2010.

The Immigration Division member claimed rightfully that she could not consider Humanitarian and Compassionate reasons regarding release from detention.

The Hearings Officer from CBSA said don´t worry they (being CBSA) will deffer your removal til after this custody dispute will be resolved. When you get a defferral of removal Mr. Kellogg can ask for an early detention review.

That would have been great instead of sending her to court in handcuffs and leg irons to argue that there was a mistake made regarding her yougest child.

The Officer deferred her removal until the day after her court appearance.

WHICH CANADIAN HAS BEEN ABLE TO GET A CANADIAN PASSPORT FOR THEIR CHILD IN ONE DAY????

Now if my client was something more than an overstay like a long time crimminal I could see some logic in showing no compassion.

The article with the picture is far superior but what do you people think.

PRRA she is from Jamaica and an overstay not a Refugee Claimant so there never was any issue of risk to her life.

Ok this is a classic example of poor planning.

As much as I can understand the humane part of all this, there are couple of things that you have to understand as well Roy.

1- A Canadian child will not prevent a removal. I think we understand that right? I am pretty sure that she was told that right from the get go.

2- This person knows and have known that she is facing an imminent deportation. It takes 10 to 20 days to obtain a passport or less in cases of emergency. Why the hell didn´t she apply for a passport for her child 20 days ago?. This has been an on going process for WAYYYY longer than that.

Does this mean that this lady has no fault what so ever?
