Subject: kid trouble
  My fiance is from Australia. We where engaged in Aug of 2010. Wedding date is in Dec 2010 in Australia. I am a single father of one troubled teen. He was doing drugs, stealing.. you name it. We ended up in a fight one night and he charged me with assault causing bodily harm(cracked nose). I have not gone to court as of yet. Definitely fighting the charge because I ended up with the worse of the fight with a broken nose, bloodshot eye and a black eye. Make a long story short.. Should we apply for spousal now or wait for the outcome of the trial. If found guilty(court systems don´t always work), is this going to stop my wife from coming to Canada? Will I be able to sponsor her? Any suggestions would be greatly appreciated .. Rick

Why is this site useless?

The thing about this site, is most of the people on this site are looking for help or trying to sell their services.
Only a few people are browsing to help.
Obviously you would need to be patient for someone to see your question and try to help you.
Most of your questions, however, could be answered by going to the CIC.GC.CA website, or a google search.

But to prove that this site is not useless I will answer your questions:

You cannot apply for spousal until AFTER you actually have a wife.
Your wife can come to Canada (unless of course she has arrests.convictions) with dual intent and apply from within Canada for spousal.
she must inform the officers when she arrives that her intent is to visit and apply from within Canada (bring a marraige cert.) She must be willing to leave if she is denied.

Noone in CIC/CBSA could give a sh*t if you have been arrested, unless you have a warrant of course ;)

There, I think this has been extremely useFULL.

BTW, as a Canadian you have a right to live here.
Your fiance does not, ensure that she is admissable to Canada.
The arrest may make you inadmissable to Australia (not sure of their rules) you will want to check on that prior to spending money and time on a flight out there.

I would strongly urge you to consider an outland application. Much faster and there is an option to appeal.
