Subject: divorceing before deportation?
ok i need information how can i rush a divorce if my husband is under a year going to be deported??? i need help

you can´t rush a divorce. you need to be separated for a year and then you file. that takes about 12 weeks for the paperwork.

You can file anytime. When I did my divorce last year I filed my divorce papers ( Statement Of Claim family law, Requisition etc... ) about 6 months after we seperated. I had my wife served by the courts Sheriff and 12 months to the day after we seperated the divorce whent before a judge and was granted. I also requested the judge skip the 30 days waiting period for the divorce to become final. So my divorce was issued immediately. I did all my own legal work and used a divorce kit.

Just to add to my post,

Sharon is correct. You can not be issued a divorce until you have be seperatedfor 12 months.

You can however file anytime and have the ball rolling. the courts will not put the file before a judge until the 12 month seperation is completed.

what happens if he contests it if i file for it now. will i still get a divorce in 12 months cause of seperation???

why do you need to ´rush´ the divorce? why would he contest the divorce? You have not answered my question about where you were married. Why is your husband being deported? Did you sponsor him?

As far as I know you can´t contest a divorce in Canada.

It is very dangerous for us to start answering one liner questions that obviously have much more involved than what the question is asking.

well when we got togther it was love and i went in blind and i wanted to keep him here with me now that he started to change and become more of a control freak he wont allow me to do anything and is giving me an allowance. he threatens me and everything he wont allow me to have friends i feel like hes isolating me i feel trapped. when he started to change i started look up information on about all this sponsorship stuff and he lied to me and i feel he is just using me. i want to get out and away from him. but hes being deported in like 8 months why i think he is also just using me for it why i want to end it and not be responsible for him. also we got married in british columbia. also he hasnt been accepted for his PR yet.

1) withdraw your sponsorship immediately. you don´t need to tell him and you don´t need his permission.
2) in BC you can get a divorce after 1 year of living apart, or sooner if cruelty or adultery are involved. Cruelty and adultery must be proven and it is expensive. There is nothing to contest with 1 year apart. You file, wait and that is the end.

If you are afraid, deal with the sponsorship stuff, go and live somewhere safe and wait for him to be deported. I would also advise CIC that you are afraid.

what can the CIC do just wondering? and if he gets deported i will be stuck married to him and i dont want to be married to him cause he leaves in less than a year. why i was asking how i can do it quickly cause once he goes back to him home country he is being made to go into the army and i prob wont be able to find him to serve him the papers

deportation is not a grounds for divorce so I would suggest you talk to a lawyer. I doubt anyone here is going to have anything they can offer you as an option.

Like I said... cancel the sponsorship - NOW
