Subject: When a son, is not a son!

When you consider a child to be your son make sure that you clarify any unusual situations.

If you have raised a child from birth that you rescued in a war zone and was unable to legally adopt due to no government make sure you refer to the child as your ________ or adopted son.

In fact list all children on the additional family information form as clearly as possible. I can find no where that it states that a male child has to be recorded as a biological son. I would consider a male child raised from day one as my son but Immigration at the Kenya Visa Post sees it differently.

There is no issue of a genuine parent child relationship in any way.

A16 of the Immigration Act states;

16. (1) A person who makes an application must answer truthfully all questions put to them for the purpose of the examination and must produce a visa and all relevant evidence and documents that the officer reasonably requires.

Now my client was found to be a convention refugee and landed but when completing the forms by himself regarding his additional family members the child he raised from birth he put down as SON.

If I had four sons I would not introduce some as my my biological son and another as my adopted son or my son who mother died in a hail of bullets while giving birth.

I think the Visa Post in Kenya has gone too far to come after my client. Your opinions would be appreciated.

I know of a family from Burma/Mayamar that wanted to come as refugees. They had 3 children of their own and 2 nieces and nephews that were ´declared as orphans´ when in fact their mom and dad were simply not qualified to immigrate but wanted their kids to have a better life so... attach them to a family and go. Or, are these children being removed from the country without the knowledge or consent of their bio parent.

in future, does that allow those 2 children to sponsor their biological parent? is lying out of desperation acceptable, or is it the necessity of the applicant to be very clear about the nature of the non-biological children.

Desperate folks will do a lot of strange things hoping to take advantage of the better developed economies! It is up to these economies to keep their eyes open and on guard.

This is the same guy that CIC investigated him for seven years before trying to take away his refugee status.

They failed and the Ministers Counsel was found to have misrepresented the evidence and did not provide ANY evidence to prove their assumption.

Then St. Clair CIC lands him and now the Visa post also CIC claims they are going to write a report for misrepresentation on his application.

It has been now 10 years since he first arrived in Canada.
