hi all, me and a relative of mine, have a company working in canada since late 2006. this company has extended its business in china in mid 2009. myself and my partner have agreed that i should settle in china for business reason, and i did move to china since july 2007. i usually come to visit my family in canada every now and then. our company in canada submits the taxation documents on time. my permanent residency card willconclude during mid 2011. the number of days in canada that i have counted so far is approx. 144 days. my question is am i considered still counting days in canada for residency pirpose while physically being in chaina, as i am the chariman of the company. thank you for your time and advice.

Outside the country (in reply to: Canadian Company has overseas business) While you are outside the country your days are not counted.

Canadian Company has overseas business (in reply to: Canadian Company has overseas business) thank you Danielle for your baluable contribution. i just visited a website called www.cic.gc.ca, and i read the following:
If you were outside Canada for 1095 days or more in the past five years
If applicable:
„h proof of your relationship to the Canadian citizen you accompanied abroad and proof of his or her citizenship;
„h proof of your full-time employment to a Canadian business abroad.
If you were accompanying a permanent resident of Canada working for a Canadian business abroad:
„h proof of your relationship to this person
„h proof of his or her full-time employment
„h proof of his or her permanent resident status.
... i have a formal proof of my full-time employment to a canadian business abrod. then why in your opinion my days outside canada will not count?
thank you again for your help.

(in reply to: Canadian Company has overseas business) Jone,
Is your partner a spouse? and is that spouse Canadian?
If yes to both then the rest does not matter, because your days with that Canadian spouse would be the same as if you lived here in Canada.
If not, then you will need to provide proof to the officers that your business was not set up soley to maintain PR status.
If the "Canadian Business" is not for the federal government or doing work for the provincial/federal government and you are the CEO (or whichever) then you will be looked at a little more than others (for the onvious reason stated above).
If this is a legitimate business then just be prepeared to prove that it is.
Good luck
JP

(in reply to: Canadian Company has overseas business) "proof of your full-time employment to a Canadian business abroad".UnQuote
That means that your Canadian business pays taxes IN Canada and you can provide T4s since you get paid by a Canadian company as well.
"because your days with that Canadian spouse would be the same as if you lived here in Canada".UnQuote
No, it counts towards his/her residency requirements, it doesn´t count towards Citizenship though, that is why, it is not same.
