Subject: Marriage abroad vs Marriage in Canada
My fiancee and I have been back and forth on this, and we still don´t know what´s the right thing to do.

I´m a born Canadian citizen and she´s from Argentina with a Spanish passport as well.

She moved here to Canada with me last year in Sept, but had to leave due to medical reasons in July of this year.

We want to get married, but we don´t know where would be the most adventitious place to help with the immigration aspect as well.

I would require a lot of documents, including a Statements In-Lieu of Certificate of Non-Impediment to Marriage Abroad if I were to go there and we get married. But it may helpful to get her back across the Canadian boarder when she returns (with me as an escort). Or, it may be a hindrance... we really aren´t sure. Based on what we have read on other forums, it sounds like many wives/husbands get turned away because they are married.

If we get her back into Canada first (using her Spanish passport, therefore no Visa) as a tourist, then we could marry here and all she would need is her passport. But... what if they turn her away at the boarder?

So any advice on this would be helpful.

Thank you

Is this the first marriage for the two of you or the tenth marriage? Whether the Spousal application is from within Canada or abroad the actual marriage is what is really important.

How did you meet, developement of relationship, plans for the future, etc.

Let´s assume that it is her first marriage and none of her family attends because your too lazy to get a document so you can get married in her country. No family on her side and no friends of hers attend the wedding you´re creating a delay aka mess.

No family or friends of the applicant attend her first wedding, Big Problem! This will happen, based on her age guaranteed.

Overseas spousal sponsorship add another six to eight months for CIC to conduct an interview.

In Canada Spousal Sponsorship add a possible two years for an interview based on the city you reside. Then there is a potential for medical problems again, GET YOUR WALLET OUT!

Then if CIC refuse beacause of lack of evidence or a silly unexplained answer there is the appeal stage only if you submitted outside of Canada.

Just because you have a piece of paper that says your married does not mean the process is a walk in the park. It is your obligation to prove that your relationship is genuine.

So is she from the capital or some mountain village?
Why did you marry her?
Why did she marry you?
Why should anyone believe your relationship is genuine and going to continue. It is a question that is not numbered on both questionnaires.

It is really great that your trying to research the process I commend you for that. Too many wait until it is too late to ask questions.

I understand that you want to wake up in the same bed under the same roof every morning but do you want to do it for ever or just until they remove her?

The answer has to depend on your personal situations, employment, residence etc. etc.

What you need to really focus on is the actually evidence that your going to submit either way.

THIS IS IMPORTANT!

With the elimination of the Pre Removal Risk Assessment all applicants who came to Canada and got married at the last second are having their PRRA´s and H&C´s joined and the decision will be rendered by one officer. They get marriage interviews first.

With the elimination of the Pre Removal Risk Assessment
all applicants who came to Canada and got married at the last second are getting marriage interviews first so they can remove these individuals.

You and your hunny bunny would wait even longer, how long 3-4 years.

There has been an average of 33,000 refugee claimants coming into Canada every year for the last ten years. 40% win so 60% lose. 2% leave immediately so 58% stay and try to stay by any means including getting married.

CBSA is lucky to remove 11 Thousand per year. Normally families are first to get removed because their easier to find and the numbers really add up.

CIC wants her to apply for her Visa outside of Canada!

I have given you logical reasons to do what CIC thinks you should do.

Think long.... and hard before submitting inside Canada.

Your choice has to be based on the two of you personal circumstances but.....prove your marriage.

Best of luck
