Subject: STUPID MISTAKE... BIG TROUBLE
  hi all!!!

i have a question regarding my little brother maybe Roy and others here can help me a bit.. so my brother just turned 18 and we are in the middle of our P.R we were accepted under H and c grounds and we are now waiting for the final step we did medical fingerprints and everything else.. so after his birthday we went out to have a couples of drinks and stupid me asked him to drive me home he had a couple of drinks and we were pulled over now he has to go to court for drinking and driving and i dont know where we stand in the immigration process can you guys tell me what its done in this case what will happen and we are a big family everyone in the same case will everyone be affected by this?

He may plead guilty

He may plead not guilty

Even the charge is withdrawn, there will be a record.

If convicted, it will be on RCMP record.

During the landing interview, the officer asks these questions, "Have you ever convicted of a crime or offense in Canada?" Or more general, "Did you commit any crime?"

Yes, it may affect other family members in the same application.

Subsection 42(a) of the Act states that a foreign national is inadmissible on grounds of an inadmissible family member if their accompanying family member or, in prescribed circumstances, their non-accompanying family member is inadmissible.

Let me tell you about the pardon process.


It´s pretty do-it-yourself if you follow the guideline.

1. get fingerprints sent to RCMP for the pardon purpose.

2. Get it in mail

3. Go to a local police station for a local check. ( about 4 weeks) from 2009 time.

OMG, something has changed.

4. Go to the court where the conviction was rendered. ( about 6 weeks)

5. Fill in the form and send it with a fee.
