Subject: Sponsoring your Spouses ..PR to Citizen

I am a 25 year old Canadian female living out of the country with my 25 year old Chilean husband. We live in Santiago where my husband is from. We have been together since 2008.

Just to give you a background before I ask my question...its A bit confusing, sorry.

His family came to Canada from Chile in 2000. They could not speak the language, and on advice of there lawyer and family they applied for refugee status. THEY WERE ALL IN THE SAME CASE. My husband was 15 at the time. He came with his mother, father and 2 brothers.

There case was denied after about 3 years. They then applied for another case, were denied. Then in 2006 they applied for HUMANITARIAN AND COMPASSION to stay in the country. When I met my husband this was the case they were on. They were working in Canada, and attending school. They had to renew there work permits yearly.

My husband and I moved in together in June 2009. ( We were not married at that time) His parents received a letter in August 2009 stating to go downtown on Sept 09,2009, that there was a decision made on there case. Bring 3 passport photos each..sounds like good news right? Well the case had been denied and they were asked to leave by Dec 05,2009. We were completely devastated. Since being together for 5 months we has never spent a day or night apart. Well because of school I decided to stay in Canada while my husband went back to Chile with his family. We were engaged to be married, so we decided to just have the legal marriage and have a wedding later. We were married on NOV 21,2009. We were going to send in the application for PR for him, while I was in school..He went and got all the medical done in Feb 2010. I spoke to an immigration lawyer who advised me that because we got married so fast after he was asked to leave, our application would probably be denied. But we could appeal. We decided against it and I planned to join him after after graduation...11 months after he left. Which I did :)

Ok so I am sorry for the long history. I just wanted o be specific, I want to do everything right. My question is what happens if in the next 2 years we want to come back to Canada? We were thinking of applying July 2012. I know he will have to do the medical again...I Saved all the phone bills and emails we sent back and forth for the 11 months we were separated. Will the previous case go against him? If the application was approved... Would he be able to apply for Canadian Citizenship upon arrival... Would his past 9 years in the country count towards that?

This refers to sponsoring a then minor failed refugee claimant.

No, if he had stayed in Canada and become a Permanent Resident, he will be eligible for a citizenship after 2 years on condition that he meets the residency requirements.

(9 years= one year) + ( the next two years) = eligible (3)
