Leaving Canada after H&C

Subject: Leaving Canada after H&C
I would like to know if I can leave Canada after H&C Stage 1 approval. Would my application still be processed from outside Canada or it will be closed the moment I leave?

I´m not sure what Stage 1 is, if it is just an acceptance of your application, no you CAN´T leave. If you do, you would never be allowed to get back in because you have proven by applying H&C that you have no intention to leave Canada. So wait till it get processed and become PR.

Under the H&C you said to CIC that you would face a disproportionate hardship if you had to go back to your home country.

That is going to look very well to the CIC officer if you are planning on going back to your home country.

If you are planning on going somewhere else, there are two things to keep in mind:

1- If you need a visa to come to Canada, CIC is not going to issue one and if you don´t need a visa more than likely CBSA is not going to let you back in, if you decide to come back to Canada before a decision is made on your application.

2- If you are not planning on coming back, you have to let CIC know of your new address. That is going to create a few questions and delay your application.

Overall....bad idea.

It depends on your application

Look at your positive H&C letter

“As you are the subject of a deportation/exclusion order, please note that the removal order is now stayed until a decision is made on your permanent residence application. However, if you leave Canada you may not be able to return (in the case of exclusion order: for a period of one year from the date you left Canada) without first obtaining authorization to return.”



“Your exemption was granted, in part, due to the hardship you would face if you were not granted the requested exemption. If you leave Canada, there is no guarantee that you will be re-admitted to continue with this application.”


It is best in your interest that yous stay in Canada until your PR is finalized.

At the landing interview, the landing officer will ask you, "Have you left Canada in the last twelve months? Let me see your passport."
