Subject: Another Question for Roy
  Roy, I´m hoping that you have some words of wisdom regarding my girlfriend´s situation posted under "Can you marry yourself out of deportation".

DocD, Sharon has provided their thoughts however I am unsure if they are in fact in the industry so I am hoping that you can provide your opinion on the matter as I have limited funds for a lawyer and if there is no recourse on her deportation then I might as well know now instead of throwing what little money I have into this.

My girlfriend is from China and basically misrepresented herself to CIC in that she came to Canada on a valid visitorīs visa, tried to get an extension on the visa upon expiry but was denied. Ill advised by immigration consultants, she applied for refugee protection and used an alias instead of her real identity and the application was rejected. She then applies under the Humanitarian & Compassionate class still using the alias, the application is currently in process however she was recently arrested by CBAS and has been in detention since as she was deemed a flight risk given her misrepresentation to CIC.

Weīve learned that inland enforcement is working on her removal however because of she threw away her passport (real identity) she is stuck in detention. Do we have any recourse at this time to stop her deportation? Can we apply to the federal courts for a stay or can I marry her now and submit a spousal application for her to remain / to re-enter Canada?

Well without reading DocD´s response I can hear my smoke alarm going off. She is burnt like toast!

Now she was the perfect little angel who got led a stray by these devious Immigration Consultants who convinced her to use a bogus name to file a refugee claim. When she went to her hearing and the Board Member hearing her claim asked if all the information in her Personal Information Form was true and she said YES!

Do you think if I told her the white stuff at the bottom of the CN Tower is nothing more than a huge Marshmellow that she would jump?

The odds of her getting an ARC are worse than you winning the 50 million Lotto Max this Friday with you having the only winning ticket.

But who knows......do you feel lucky?

What he is asking is if he can do anything to avoid her deportation since she is still at the detention centre. He figures that going to the supreme court or marrying her can do it. I already answer to this but he wants to hear a magic sentence "oH YEAH THIS HOW YOU DO IT".

This is what I said:

"No, her deportation is imminent. The fact that she used a fake name for the H&C application as well as for the refugee application was a very stupid move. Her finger prints are on file and CBSA found out that she mireprensented herself.

The problem is going to be to get a travel document. That might take awhile but if she has been deemed as a flight risk, more than likely she will spend a few weeks in detention until CBSA can get a travel document.

Forget about the in-land application, itīs not going to fly.

Your only option would be to sponsor her as your wife from outside of Canada and submit an ARC with the application.

As a side note. You are going to have a hell of a time proving that the relationship is genuine since is very obvious that she is desperate to stay/move to Canada.

I hope you realize the kind of person you are dealing with.

Either way, her butt is going to get deported from Canada and banned from entry".

Telling him that she has a better chance to win the Lotto Max 50 million this Friday with the only winning ticket instead of being allowed to remain in Canada was not clear enough?

DocD I was not being critical of you I was telling him you and Sharon probably answered his question and I was implying I am not a miracle man who can pull a rabbit out of his hat every single time when people make mistakes or tell HUGE LIES!

Regardless the desperate will not listen to logic they just want to hear put the money on the desk and I´ll take care of you. Then they accuse the representative of giving bad advise.

Okay DocD he is in Canada and I think she is in the GTA so they could have called but didn´t so that means that he wants attention and compassion but compassion has to be common sense.

for your response, I just wanted to ensure that all avenues have been exhausted which is now confirmed by a immigration specialist, yourself although my sense on the advice from DocD and Sharon was valid, just needed this final confirmation.

I am not opposed to listening to reasoning or logic but only wanted to certain before I tell my girlfriend that there is nothing further that can be done.

Just of clarify, all of this immigration "stuff" took place before I met her and I had no clue of all that took place with her refugee / H&C app until she was arrested by CBSA and then bit by bit the truth trickled out.

She and her freinds are exerting a great deal of pressure on me to save her but it looks like its the end of the road to Canada for her and I can state this with a clear conscience that at I tried my best to help her out of an impossible situation.

AliCat, in situations like this, as the Canadian... guard your heart. People are desperate for Canadian status and they will say and do almost anything to get it.You should never be pressured into doing ANYTHING to save someone from bad decisions. It is a great way to get used and hurt.

Sharon, I appreciate your advice and truly take it to heart.

I was hoping to gain some insight into this situation before contacting anyone so as not to waste others´ time contrary to the comments from above that I was looking for compassion.

The reason why I feel pressured is that I think my family blew the whistle on her that lead to her arrest and I have no idea on how they obtained some of the evidence that is now with CBSA but I am trying to remedy the so-called wrong that my family had commited against her by helping her as much as I can. Needless to say, my family is also worried about the same thing that are you warning me about.

I don´t know that CBSA would do this but my girlfreind told me that when she was arrested, one of the officers spoke Chinese and told her that it was my family that provided them with the evidence so that´s why there´s the pressure from her and her friennds.

Sorry to burden you with my life story here but I just wanted to thank you for the sound advice and set the record straight.

I heard that its possible to appeal the detention order in the Federal Courts, is this true? I would assume that this action would require a lawyer as opposed to an immigration consultant?
