Humanitarian and Compassionat Applications are not a simple issue.
Knowing what are real good H&C factors and believing your right because others won are two very different things.
Immigration will tell you follow the forms in the guide, don´t worry, be happy you do not need to use a representative!
Most would think that if you did your application yourself that the Immigration Officer might allow you to be not too clear on what you think are H&C factors, WRONG!
I have an Un-Wed Mother from China who claimed she will suffer Unusual, Undeserved and Disproportionate Hardship or cruel punishment if returned to China. Having a child while your not married is against the Law in China and she will face a fine of six times the disposable income plus many other problems! $140,000.00 Canadian fine!
My client did her H&C application herself but Officer Neufeld in Niagara Falls CIC focused on that parents of above quota children can return to China and (MAY) not be fined! Officer Neufeld quotes a Professor from the University of Alberta so I emailed that Professor and he claims he was talking about the Paris Hilton´s, Lyndsy Lohan´s and Jackie Chan´s etc.
Ms. Wang only has one child. She is not married. Then Officer Neufeld wrote in her decision that a Canadian Child can go to China and live with her Mother for ever without giving up Canadian Citizenship. WOW I wonder how many children from Haiti have been allowed to live in Canada without status for two decades?
I thought about that (MAY) not be fined so I bought a Lotto Max Ticket because I (MAY) win and guess what there is only one 50 Million dollar winner in Canada and the winner is from Ontario. So I (MAY) be the winner.

Ms. Wang was upset that if fifteen of my Un-Wed Mothers from China won their H&C applications, why did she not win!
The H&C Factors have to be clearly addressed and doing something in your second langauge is never clearly understood. What is worse when now all H&C Applications are joined with the client´s PRRA´s a new H&C Application will not prevent ones removal from Canada.

She had heard of my many H&C successes with Un-Wed Mother´s from China. She submitted an H&C application herself and waited, waited and waited somemore. Then she was called to a PRRA and they linked the H&C with it. She believed in the Canadian Charter of Rights and Freedoms and believed that if others win she should win, WRONG!
She claimed she was unmarried and had a child and did not have permission of the family planning policy in China, etc. etc.
The CIC Officer that assessed her H&C and PRRA assessed her as a person with an above quota Child that (MAY) not get fined if she returns to China with her (ABOVE QUOTA CHILD).
She has only one child!
The CIC Officer wrote three sentences when it came to the issue of the Best Interest of the Child - three sentences!
The Chinese Nationaility Law found here section 5 http://www.chinaembassy.org.nz/eng/lsqz/zgygflgd/t39423.htm
states if one of the parents has "settled abroad" the child will never be able to obtain Chinese nationaility.
Ms. Wang has been in Canada for seven + years and does not consider that settling abroad. Apparently the dead beat dad has been here longer without status.
See everyone in Canada is to be treated equally even you HOOP if 18 other Un-Wed Mothers can be shown compassion so should Ms. Wang.
China is the only country in the world that does not allow a women to have a child unless they are married.
Penalty to be imposed is six times the disposable income! Approximately $140,000.00 Canadian fine. Plus, Plus, Plus.
