Subject: Husband Denied TRP Because Intent is to Stay..HELP
  I am Canaidan and met and married my husband while living in working in the US on TN Visa. We have 2 children (5 and 1 1/2yrs) and have been married for 3 years. He has a DUI on his record and I wanted to return to Canada with my family to raise my children. We applied for a Temporary Resident Permit (TRP) to overcome his inadmisability as recommended on the Canadian Consulate website adn I returned to Canada with the children so my daughter cold begin school in Canada this year.

While there is no mention of needing a sponsorship agreement for ´criminally inadmissable´ people on the website, his application was rejected because I had not yet sponsored him. They are stating that because his intent is to remain here permanently then he cannot be granted a TRP because this is for temporary purposes only. My Member of Parliment sent a letter to Jason Kenney (minister of immigration) asking him to review this and he replied by saying that a qualified official made this decision and it is valid.

I guess I just don´t understand because I have read ionformation on ´Dual Intent´ and didn´t think that he could be refused a TRP based solely on the fact that his intention was to apply for Permanent Residency when the 5 years following his conviction is up, which will be May 2011. We only asked for TRP until which time we can apply for PR and if denied we will leave Canada adn go to Kenya where my husband is from. Is there anything I can do to get my husband into Canada before applying for PR in the Spring? We have been apart for 7 months already and it is really hard in the children. Thanks for any advice.

DUI is considered an extremely serious offense by Canada´s immigration law, so much so that even a perfect case (highly educated and capable scientist who would be an asset to Canada as a permanent resident.) can be gone wrong.

My husband has his TRP and we want to move to Canada..I am Canadian and he is American...He already has a job offer in Canada but does not have a work permit nor SIN...what is the best way to move forward?...Just show up at the border and apply for the work permit or?..looking for any advise...
