Subject: how to apply as common law partner
HI, me and my gf have been living together for more than a year and I have been working for more than a year and qualify for the Canadian Experience Class.
I would like to apply immigration together with my GF as common law partner and me being the principle applicant.

My question is how to be a common law partner in Canada ( we live in Toronto) ?? Do we have to be common law partner legally before we submit our application? or we can just do the whole process together (i.e. to apply common law partner and immigration)??
PLease help ..
thanks

Zack

Just submit under the CEC class but be sure to include her own schedule one and additional family information forms.

Then go to overseas spousal sponsorship forms and complete the Statutory Declaration of Common Law Union form found here http://www.cic.gc.ca/english/pdf/kits/forms/IMM5409E.PDF

Thanks for pointing to the right direction/

Forgive me for asking the same type of question again. So there is no need to apply " common law partner" status elsewhere, like going to city hall (if thats the place to do it) and get some sort of certificate???
All i have to do is fill in the "Statutory Declaration of Common Law Union form"??

Thank you so much
Zack

Hey Zack, that is correct. You don´t have to apply for common law status or anything, just the fact that you and your girlfriend have been living together in a serious committed relationship is enough.
The "statutory declaration" is definitely what you need, but also remember that you need to be able to show enough proof of your common law relationship.
Best of luck

so do I have to mail in the "proof" along with my application the first time I submit my application?? if so do we have to mail in the original copy or we can do it with a photo copy (just worry the lease and everything may be lost in the mail)

we have
i) rental lease for the apt
ii) joint account for over a year
iii) auto insurance ( 2 months only , got a car recently)

my marital status when i come to canada is married. I have no communication with my husband since then. Now, i am reunited with my first boyfriend and we are living together now here in Alberta. He had a devorce in a while and he wanted to sponsor me as a common law partner. Do i have to file for annulment with my marriage in Philippines before we proceed with our application?

Hi my fiance is applying through the Canadian Experience Class for his PR. We both have an idea what applications we need to fill but are unsure of a few other things. Do we both need to do the English Language Proficiency Tests? Do we both need to submit new Medicals and finally do we both need to get Police Reports? Any assistance would be greatly appreciated
