Subject: Notice to Appear for Deportation?
  Hello everyone
I received this letter:
´´The attached letter has advised you that a proceeding by the Minister under Subsection 44(2) of the Immigration and Refugee is to be held.Please bring your Passport.
Notice to Appear for Proceeding under subsection 44(2)
Report submitted under paragraf 40(1)(a),20(1)(a).

There is attach a Letter from the Immigration Officer with his opinion.

What can I do at this time?

If I leave before the date I have to go to the Office ?

What happend when I go to the Airport ?

Well it appears you got written up for misrepresentation and you received the report as to what you supposedly misrepresented! So you know what they are talking about!

It appears to me that your being taken to an inadmissibility hearing where you (may) have a removal order placed on you at that time.

Since you may be a PR there is an appeal process.

Do you not think it is about time you sought advice from an authorized representative who has experience and is qualified to answer your questions? You need to sit down with someone who is knowledgeable regarding your personal situations and hear your options.

Make sure you get references and see files that he/she has been successful with other similair cases.

He is being told to go to an office, (key word office)so he probably is a PR.

Not necessarily. As you know he got written up for misrepresentation.



Read ENF 06:

A person claiming at a port of entry or who makes an application at an inland office that they should be allowed to come into or be authorized to enter or remain in Canada, as the case may be, must truthfully provide such information as an officer may require for the purpose of the examination [A16(1), A20(1)].

If he is a PR he may appeal it, if he isn´t... he is pretty much toast.

Get some help, CIC is coming after your PR status based on misrepresentation and once they revoke it, then CBSA will deport you.

A glass of Red Wine or a Beer would be better since I´m already drinking my cofee.

Normally first your called in and asked to answer a few questions. It is how you answer those questions whether your sent to a admissability hearing.

Then at the hearing you need to defend yourself based on CBSA evidence and not try to prove your innocence or explain anything.

Save that for the Immigration Appeal Division Appeal. Whole process could easily take longer than a year.

Yes Milky hire a Lawyer who has never done a vacation hearing or a A40 allegation with the Immigration Divison never hire a former Hearings Officer who has done hundreds of these cases.
