sir plss help!! my wife is applying for a candaian work permit in LA as a caregiver for elderly,she has a US tourist visa which has expired last jan. 24 2011,but her I-94 is still valid up to feb.14 2011.my question is, if her application is submitted atleast by feb.10 will there be any problems or conflict with her application since her US visa is expired.and if submitted successfully how long is the waiting time for the result? thus she need to submit medical examination result right away?by the way the reason why its taking us too long to submit the application is because some of the requirements needed are still on the way.hope you can help us.thank you very much

Are you familiar with the penalty if someone overstayed her temporary visitor visa in the US?

yes sir we know the penalty.and my wife has no plans in over staying,that´s why what concerns us sir is,will her application for the work permit be rejected if submitted few days left before her i-94 get expired.by the way sir she is planning to submit her application personally or as a walk in application.plss helps us we are running out of time and we are confused of what would be the best thing to do with our case.thank you very much

Regulation 11 allows you to apply in the States if your wife was originally admitted for one year and she currently resides there.

no sir you got me all wrong.my wife is still in legal status in her stay in US even if her US visa has expired already,as long as her I-94 has not yet expired.And her i-94 is still valid till feb 14 2011.that is why i am asking if ever my wife succesfully submitted her application by feb 10 with only 4 days remaing before her I-94 get expired will that give any problem with her qualification as a caregiver.tnx
