  If a person was convicted and subsequently appealed and won the appeal in that the conviction was quashed and the stayed and the individual is applying for immigration to Canada through Spousal Sponsorship could this cause criminal inadmissibality and would the individual need to apply for a pardon?

Would it be wise to ask the visa office to consider granting a TRP in the event this causes criminal inadmissability. How does a persons ask for TRP, would a letter with the file number be sufficient coming from the applicant asking the Visa Office to consider issuing a TRP in the event the person is found criminally inadmissable?

Where was the person convicted of an offence? in Canada or elsewhere?

How long has it elapsed since the original date of conviction?

Where is the person right now in Canada or elsewhere?

For the outland application, the person needs a criminal rehabilitation, for the inland (within Canada), a pardon process.

no conviction is NO conviction. not sure why you would need a pardon from no conviction.

A:Even if you were found not guilty, once you have been accused and charged with a criminal offence, a record does exist, and you must complete paperwork to have your record destroyed or sealed.

If a person appealed a conviction and received an absolute discharge because they were found NOT GUILTY in a higher court no crimminal conviction exists.

No record of any conviction exists.

Why are you worrying about such a silly little thing. Go get your Police Clearance Certificate and if says you have no convicitons you don´t have any.

Anonymous 233.201.58 the person asking the question will be the applicant in an overseas spousal sponsorship application. The IMM 008 Schedule one does not ask have you ever been "charged" so stop trying to put out red herrings to upset people!

Try readng the question and because of many of your responses I suggest you read the question 10 times.

Why (MUST) a spousal applicant complete paperwork to have their record destroyed.
