Subject: Information about PR and H&C
  My name is Eric,

I have landed in Toronto in July 2006. My PR is valid up to Sept 28, 2011.
I have spent only week in Toronto in 2006 and I came back for an additional week in Jan 2011.

When I have received my PR in 2006, my mother was in the middle of breast cancer treatment and a divorce process. She was job less, with no shelter and no medical insurance as well. It was quite difficult for me to move to Canada knowing all the difficulties in finding a job before sometime 6 - 8 months. I had to take an overseas assignment in Africa to earn sufficient money to support her and keep this assignment until I was confident that she won´t need that much money for her treatment.

She had a second cancer in 2009.

When I went to Canada in Jan, 2011, the immigration officer at POE (Port of Entry) sent me to the office in St Clair so that I can explain my case.

Reaching there an immigration officer explained to me that I will remain a Permanent Residence as long as my card doesn´t expire while I am abroad and that I should find a job, a house and stay in Canada for 2 years before I ask for renewal. If I go back I should be able to enter back. In worst case scenario they will send me back to the Saint Cair office again.

But my problem is a little bit more complicated. I´ve got married in 2009 and I now have a wife and a 2 years old baby. This means that none of these family members have Canadian PR.

I am now out of Canada and I am planning to move back for good in Mai 2011.

I have 2 options now:
- Option 1: I move to Canada and spend two years, renew my PR and sponsor them.

- Option 2: I move to Canada, find a job, a house and apply for H&C (so that I can quickly sponsor them) provided that I am not stop at the Port and Entry and forced to apply from H&C immediately. I know that this option will not be without trouble.

I wish that I won’t have to stay too long in Canada without my family.

I have a few questions:
- My son has a French passport and doesn’t need a visa. Will he be able to visit me over these 2 years?
- My wife doesn´t have a French passport yet. Will it be possible for her to apply for a visitors visa?
- What are your advises, should I try the H&C later on (provided that I am not stopped at port of Entry from the beginning) and then sponsor them?
- What are the possibilities if my wife comes on business visa?
- Will they this time again let me in without difficulties?


Please try to help me; I am desperate to find solutions to my problems.

You applied for PR status and never became a Permanent Resident! Now you want compassion?????

You have a two year old son who can be admitted as a visitor but not your spouse.

You have a record of non-compliance regarding your residency status due to your first visit to Toronto Central CIC aka St. clair.

Can your wife APPLY to get a ride on the last shuttle mission to the space station? YES

Can she apply for a visitor visa to Canada? YES

Will she be given a visitor visa - maybe depending on her status and reason to return to France or country of origin. After her temporary stay.

Here comes the bad news.

If your written up when you return for not complying regarding residency requirements you can claim H&C reasons for yourself but you can not sponsor your wife or child until that is dealt with even if your residing in Canada.

It would be far faster to have her apply for PR status if her occupation is listed in the Ministerial Instructions list.

Your behaving like your extremely special or like a brother In Law of a former Tunisian President.

H&C applications are for unusual, undeserved or disproportionate hardships situations.

Sorry to hear that your mother was suffering from cancer but so have thousands of others childrens parents gone through that process. If your mother was in France they have a very good medical system that would have been very capable to take care of her needs. Watch SICKO

Compassion has to be common sense and I for one do not buy your story as presented here in your fist posting.

Nothing Unusual,

Nothing Undeserved,

Nothing Disproportionate!

You decided to NOT comply with your residency obligations for other reasons.

Your up that creek without a paddel and your boat has a HUGE hole in it! Just the truth.

Is there a way out of your situation - maybe - but without knowing more about your situation it looks very dim.

Do you meen that they won´t let me in this time?

Will I face a removal order?

If they let me in, Can I spend my 730 days before I sponsor them?

I REALLY WANT TO MOVE THERE IN MAY WHAT DO YOU SUGGEST. I AM READY DO RESIGN FROM MY JOB TO BE THERE. AM I TAKING UNNECESSARY RISKS AS I HAVE NO CHANCE AT ALL????

Information earned (in reply to: Information about PR and H&C)
A Permanent Resident who did not fulfill his or her residency obligation and who came back to Canada a few months before his PR card expires is sent to a local immigration office, given a chance to explain and depending on the cases, told that he could apply to renew his PR card on the condition that he stay in the next 730 days in Canada.

Here is a guy who has already have a history of non-compliance with residency requirments.

Lets say you get caught speeding 60K in a 40K school zone on a Sunday and you get a warning. What will happen on Tuesday just before school if you get caught again doing 60K in a 40 K zone?

No ticket - LOL, Yeah Right!

First time you get a slap on the wrist (possibly) but not the second time. Why do you let on that the rule of the Law would be ignored.

This guy does not deserve compassion and you telling him everything will come up smelling like Roses is an
injustice.

PR Card Out Of Status (in reply to: Information about PR and H&C)
Hi,

I got my PR in 2006 and landed into Canada, stayed for a month and returned to sell off my house/car, quit my job and draw out my bank savings.

I had a bit of downturn, when I met with accident and broke my right arm in three places (and my front tooth).

It has taken four years of physiotherapy and strength training to get my arm fighting fit. Now I can do everything I could before the accident.

However, this was a setback for me and delayed all my other plans of selling the assets; when I was finally done with all of it, I realised that I was no longer in-status.

Now, in February 2011, would it be a good idea to go back to Canada; meaning thereby that will they be congenial enough to understand/care and allow me a second chance?

I suppose there is no way to be really sure of it, still, I´d value anyone´s learned opinion.
