Subject: Ohip Denial
  My Parents are 76 yrs old and Canadian Citizen since 1997 and had Ohip card. Between 2008 and August 2010 they have been in and out of Canada. Finally August 2010 they permanently settled back in Toronto. In 2009 ohip locked their accounts and when they applied to reinstate the account OHIP is asking for Documentation to prove their residence from 2009 which they can not provide. The administrative appeal has already been denied. They have an option to appeal to HSARB. looking at the facts I do not know if review committee appeal even has a chance. I am looking to see if there is any way for them to be eligible for OHIP benefits since they are elderly and definitely need Medical attention. Your help will be highly appreciated.

They would have qualified for OHIP again after living in Canada for three straight months after returning in August 2010 (this assumes they didn´t leave the country again). When they applied to have OHIP reinstated, did they misrepresent the fact that they had been out of the country for two years?

Regardless, rather than appealing when they were originally denied - they should have simply waited until they accumulated three months of physical presence and then reapplied.

Have they been physically in Canada for the last three months? Do they have documents to prove this? If so, I think they should reapply rather than appealing.

yes, they have been living in Canada since August 2010 and established their residency. They tried to reapply as a returning resident and provided all the documents to prove it e.g. lease papers, bank statments etc. Apparently, the account is locked. Will they be eligible to apply at a later date?

Aisha, go to your local MPP office, since this is provincial level matter, MPP office will help you!
