File your tax together with your spouse with zero income.

Not declaring your poker earnings is entering into murky water. If the money is being wired to your account here in Canada from one of the main poker sites you may be found out and charged back taxes. Changing legislation internationally may mean that your online activity will be reported by poker sites as well.

My partner makes his living playing poker. When he was working as a lawyer he did not need to pay taxes on them but now that it is his primary occupation he does need to pay taxes (and registered as a business to do so). He consulted a top gambling lawyer and accountant to confirm that this is the best course of action.

It sounds like you´re already into shady business with your rejected refugee claim and subsequent marriage with no formal employment. Be careful adding tax fraud into the mix.
