Subject: Transfered H&C timeline in Vancouver
  Hey guy, Am just wondering if anyone know or have an idea about the new H&C applications in Vancouver. I applied last September and my file was later transfered to Vancouver local office. I read it on CIC web site that they´ve funded them with little cash to enable them consolidate all existing H&C and PRRA.Since there is new regulation guiding H&C since last year 2010. think they should be more effective in making decisions. I learnt that Vegreville is just a location to check if everything is okay with the application, and later transfered to Vanvouver for initial first stage.I think why most of the previous H&C take so long is because they combine them with the PRRA since there are element of risk in the application. The new regulation is base on hardship and the level of establishment in Canada. Please if anyone have the new time-line or any current news about H&c in Vancouver.I heard some people have decisions in five to six months? Am not sure but just saying what someone told me of late.

I know you guys all want to know WHEN, HOW LONG, WHAT IS THE TIMELINE.

Henry your no different than any applicant who has applied for a FSW, Spousal Sponsorship, Appeal, CEC, PNP etc. etc. etc. You all want to know when will I get a decision.

Last week I talked with a man who sponsored his spouse who was going through the refugee process and had not had her hearing as of yet. They received stage one approval for their In Canada Spousal Application. They set about getting PCC from her country of origin to assist CIC with stage two approval.

The Lawyer then told them you have just lost your refugee hearing pay me and I´ll file an appeal or else they will throw her on a plane. So they paid! They believed the Lawyer and got terrified about the time frame for approval so they lost several thousand dollars because they focused too much on WHEN!

When one is stage one approved their removal is automatically deferred.

Too many have applied for H&C in the GTA without understanding what it entails to prove compassion is deserved. They are now dumping most of the old H&C files to VANCOUVER.

Instead of focusing on HOW long or gossip I suggest you focus on improving what has already been submitted. Expand on your Unusual, Undeserved or Disproportionate Hardships.

Thank you very much Mr. Roy for your professional touch and advice. I understand i have to continue to work on what i submitted to them.You said something that most of the old H&c are now transfered to Vancouver. Agreed, but what i just want to know is that since most of those H&C are attached with PRRA applications, do you see any positive improvement in the new H&C that was recently submitted after they make new changes to H&C?My PRRA is here in dundas street and my H&C in Vancouver. This ism y dilemma Mr.Roy. Thanks again for your advice and i´ll continue to work on that.The difference in my PRRA and and H&C is just three months. I submitted my H&C in september 2010 and PRRA in December 2010. I go to school and currently a Practical Nursing student in Toronto. So sad.....hmmmmmmm.

ROY, any info about the approval ratio of H & C with risk at the CIC Dundas office?
I know my question sounds stupid but you are in the field and might know something?

Hi Moe,what i understand is that, most of the the old H&C have been transfered to Vancouver. The new ones will take a new dimension since there is no more risk attached to the new applications.The new ones are now goes with how well you´ve established yourself in Canada.Plus the undue hardship and whatever.The old ones that was submitted before the new law came into existence will be forwarded to PRRA unit in Vancouver. The new applications will not go through PRRA units even if risk was mentioned in the application.You can ask Mr. Roy more for more professional opinion and advise......Let me know Moe if you have any updated timeline about new H&C application.

Moe when did you apply for your prra and h & c?. My h & c was in september 2010 and prra in december 2010. with that i read on the cic web-site that they´ve moved all existing prra and h & c to Vancouver for further assessment. My H&C is right there in Vancouver and prra siting @ Dundas. I think your h&C you filled was involved with risk? The new ones do not have to go through prra units even if it indicate risk. So when was your application submitted Moe?

H & C IN 2003 and prra last month . both back to back; first applied prra last month and then they ask for h & c updates last month.
my file is still at dundas cic till today.

H&C factors and PRRA factors

Should be different and risk should be kept out of H&C applications by all means.

Then people read the PRRA manuals and forms and see the phrase CRUEL AND UNUSUAL PUNISHMENT!!!!

They then compare that to Undeserved, Unusual and Disproportionate Hardship and ask themselves what is the difference!

Do not try to retry the Refugee claim that is for the IRB and it has already been refused.

Remember Compassion has to be common sense and if your on welfare stealing tax dollars don´t waste the Officers time.

Hi Everyone, just want to ask a silly question, because am a bit confuse. The CIC agent i spoke with yesterday make things worst for me. Is there any difference between further assessment and in process.My file transfered to Vacouver office this year January. The agent said ´´ my case is not in process´´. I just don´t get it. I called last few weeks and the agent i spoke with said ´´everything is fine and if they need any additional information, they´ll get back to me. Please i just want to be more clear on this issue. Any positive contribution will is welcome.
