Subject: I need advise, Refugee Claim after arrival
  I came to Canada in 2010 and It´s been one year since then. I didn´t make a refugee claim immediately on arrival because of fear of facing the authorities because I believe that I would be taken back home. It is one year and 2 months now, I do still a valid student visa. I do have a credible story to submit a claim.

I do believe that,However, a claim be credible even though it was not made at the earliest possible opportunity. A genuine refugee may well wait until he or she is safely in the country before making a claim and cannot be expected, in every case, to claim refugee status at the port of entry.

Well, I need someone to shed more light on the possibilites and challenges ahead if a make the decision to go and make a refugee claim and what would be my chances of having a successful claim. And if not, what would be the necessary steps I would take.I will appreciate any advise.

Being in School as a foreign student and able to speak English you still waited a year to make a refugee claim. Hmmmmmmm

Well I bet you go all in with a 2 - 7 off suit as well.

Both can work but the odds are........

Now what about the CEC class? To me that seems a better option.

Roy, the odds are that I dropped out of university after a few months because of challenges beyond my control, I have been doing self-study and studying something part-time on the side basically hands on experience, so I dnt think CEC Class can work for me because I don´t have the full-time hours.

Nevertheless, I do have a girlfriend who is a permanent resident with whom I am living with, she suggests that we get married and submit in a spousal application but the challenge is that she has just been here for the same time as me because we came on the same time though she was landed.. How is that if i took that route? Shed more light on this for me.

Last question, Do you believe that delaying in making a claim would affect it´s significance or the credibility of my claim and evidence to support my story will put me in a better position?

If she is a PR over 18 years old, shouldn´t she be able to be sponsor?

Anonymous, well I do believe she can sponsor but then my worry is that her financial credibility could be taken into account,she is not working, just going to school. Don´t you think she has to meet the income requirements?

You asked the same question under the name "Kay" in a previous post.

There are no financial requirements as sponsor. Refugee claim? As I said before, you didn´t properly used your visa, you are living with your girlfriend and your visa is about to expire and you know you can´t extend it so you are going to fill a refugee claim hmmmm. You don´t need protection, you want to stay in the country.

Ain´t gonna fly.

Before your permit expires, leave the country and come back as a PR either as a sponsored family member (common-law if applicable or spouse) or a skill worker.

An In-land application isn´t your best option, your whole scenario is going to trigger more questions than you can believe and a refugee claim is not going to work, the officer will eat you alive in the interview.

There are two basic problems. You are in Canada as a student and you are not studying and you want to become a refugee in seek of protection who has been in Canada for a year and living with a girlfriend who came at the same you did as a PR and you want to apply now that your visa is about to expire?

Think again.

DocD, well i credit your advise and let me think again. Well can I make the skilled worker application from outside canada?

Can I qualify in that category and will they consider the fact that I didn´t use the opportunity to study when I was granted a study permit, will that affect my application made from outside canada let it be spousal/skilled worker application? Clarify me on this.
