Subject: Sponsoring - do it from Canada or out
Hello, I´m about to try to sponsor my American husband. I am a Canadian citizen who has been living in the states and can no longer stand it here.

Would it be easier for me to return home while I petition to sponsor him, or would it just be as easy to remain in the US with him? I don´t want to be apart from him for a year.

Also, I have been in many off and on jobs due to getting used to the country and then became a student - I don´t make much money, can I still petition him? When I check the CIC site, it says I should make about 23,000 to be able to sponsor him. My parents would sponsor him too, but apparently that´s not allowed. Would I even be able to sponsor him in the first place?

Thank you.

Hey

Yes, you will be able to sponsor him while staying in the states but you have to show plans of going back to Canada for example: where are going to stay? , job offer .....

Did you ever receive social assistance? any job with an income to prove that you are able to support your husband will strengthen your case because you will be responsible for him for three years, but if you dont have a job it doesnt mean that the app will be refused but it will definetly raise questions and you dont want that. You can maybe include a bank statement that shows you have money in your acoount which will be enough to support your husband or maybe show that you have assets that your going to sell like (car , house ).

Your parents cant sponsor your husband

Hope this helps

I never received any social assistance of any kind. We do have a car here we could sell and I have a decent size savings account.

Thanks for all help.

Outland application, showing intent to return to Canada. The best way to do it. There is no income requirement for spousal sponsorship. Just make sure you do a very good job of showing the relationship is genuine.

If he has any sort of criminal record - that would be your biggest obstacle.

Sharon, why do you say there is no income requirement for spousal sponsorship? I see nowhere on the CIC that says there is an exception for Spousal sponsorship. It says all families of 2 (including yourself) would require the sponsor to make 32,000. If this is true, I´d be very happy. But, I don´t see it in writing anywhere.

The numbers you´re looking at are either what you need to be making if you want to sponsor a member of your family who is not your spouse or a dependent child - or alternatively, what you need to have in your bank account to immigrate yourself with your family. As others have said, there´s no minimum income to sponsor your spouse (you just can´t be bankrupt or on social assistance). My husband´s outland sponsorship application was approved towards the end of last year (he´s American as well) and I can guarantee you that no minimum income applies.

The following page outlines sponsor qualifications and responsibilities. You´ll see that minimum income isn´t listed:

Thank you so very much! :) Definitely looking into this seriously now, just to decide if I want to move back to Canada to do it or not.

See the sponsor guide pages 8-9. The exclusion is outlined there

As an aside, you should familiarize yourself with this guide (as well as the applicant guide) as soon as you can. These guides contain information that is crucial to your application.

Want to thank everyone for their help. I also favorited the guide Anonymous linked. I am now getting in touch with my family and we´re going to start arranging things soon.

Thanks for showing me that something I thought was impossible isn´t!
