To All
Sometimes it is best to have an overly aggressive enforcement minded CIC/CBSA Officer assigned to your file.
When CIC Officers refuse your H&C application and you know their decision lacks logic do not give up. Use their ignorant words and find evidence that they are wrong. Submit another QUALITY H&C application with a Counsel that you can convince your situation is unusual and undeserved.
If all else fails and you still believe that you have been wronged turn to the Federal Courts because having an H&C application in process will not prevent your removal.
If CBSA gives you a direction to report to the airport on a particular date retain QUALITY legal counsel to submit a deferral of removal request. The vast odds the deferral request will be refused then Legal Counsel will go to the Federal Court to seek a Stay of Removal.
This week one of our clients got a Stay of Removal because the Justice department never presented any medical evidence to show that our clients did not face a severe risk if removed.
Now we will update their H&C application and in about three months they will be applying for Landing.
When it is common sense that you should be shown compassion some CIC/CBSA Officers may write down the best evidence to keep you here. TY CIC/CBSA for hiring at least one or two uncaring overly aggressive staff who want to kick out even well deserving applicants.
When your right and can prove it, shout it from the highest hill you can find.

OPPS actually it was around 5 in the morning when I posted that because people dealing with CIC/CBSA Officers should be happy when they get overly aggressive enforcement minded Officers because it can really help their situation.

The difference is that I win and I can prove it those that advertise claim they´re good but have difficulty proving that they are a quality representative. Why?
Now for Cornflakes comments, know your facts.
Cornflakes the answer is NO because your advice is poor as well.
This family hired a Lawyer to do their first H&C and he did little but mostly poor research. Then they got lucky they got a extremely enforcement minded H&C Officer who claimed Benadryle & Coricidrin are readily available in Manila.
Benadryle and Coricidrin to take care of severe Anaphylaxis shock.
The issue is that in the Federal Court CIC was represented by the very experienced Justice Department Lawyers. All those experienced Lawyers representing the government never even challenged my H&C evidence that her child would receive irreparable harm if removed.
Yeah a Consultant´s evidence on an H&C application was so clearly expressed that the Justice Department rolled over and gave up!
Now Cornflakes as I said before "My ancestors invented breakfast cereal,what did your ancestors invent"?

You aren´t a lawyer, and while you mention, "retain QUALITY legal counsel," in your tub-thumping, some might mistake you for one. You should articulate that you´re not a lawyer if you´re going to yak about the federal court.
As for the namesake business, I will concede that you are a very Special-K.

The issue is only retain a representative that is knowledgeable and experienced about your personal circumstances.
Only hire a representative who will spend the appropriate time required to ensure that any application submitted on your behalf will increase your chances of success.
Few if any Universities that offer Law programs teach one class in Immigration Law. Many Lawyers have absolutely no experience in Immigration Law yet they are allowed to practice Immigration Law.
The ground work has to be done long before ever going to Federal Court and not all representatives are equal.
Only hire quality so it is your responsibility to research any representative.
Google their name with the word Immigration and find out if others have said negative comments regarding their quality of work. As I have said many times get references and if they will not provide references do not retain. Check to see how long they have been in the Immigration Business. Do not be fooled by a fancy office or a nice suit!
If on the Internet it says "Help Needed in Suing _______"!
