| Subject: URGENT! about conditional discharge for p.r appl. |

I applied p.r. under spouse sponsorship in Canada and got A.I.P and open work permit. But unfortunately, I was charged by the police and recently given conditional discharge and one year probation. I really concern about my P.R.application. Is it will be delay or refuse? anybody knows?please,please .

Yes it might delay the process..but the good news is after probation is over you won´t have a problem getting your PR ,conditional discharge is not a conviction for canadian immigration purposes ,so be careful and stay out of trouble and make sure to let them know or you will be in trouble then.

If your in the GTA the processing of stage two can take 2+ years.
It all depends on your conditions and 190.149.53 is totally correct and Anonymous 232.244.253 has just shown their ignorance when it comes to Canadian Immigration again!

When you apply for re-entry visa outside Canada, make sure you check YES to "6. Have you or an accompanying family member ever committed, been arrested for or
been charged with any criminal offence in any country? in IMM 5257 - Schedule 1]"
When you renew your open work permit while in Canada, be sure that you check YES to 13. Have you or any of family member ever been convicted of or been charged with any criminal offence in any country? in IMM 1249.

What I pointed out was that it is important that you reveal your ´unfortunate´ dealings to CIC in either application.
To get approved or refused is the sole responsibility of CIC.
The best scenario would be that you´d be issued Temporary Resident permit in order to overcome inadmissibility until your probation elapses and be asked to submit Pardon while you are in Canada (Criminal rehabilitation while waiting for PR outside Canada). CIC will assess all aspects of your dealings such as nature of charge, time elapsed since the discharge, etc before making a decision.

I checked the CIC, the conditional discharge is not inadmissible for canada immigrate purpose.So, Can I understand that they won´t refuse me to renew work permit because of this discharge, and for sure I will disclose everything to them.
