Anyone can say you should of sought advice before you went for the interview or better before you even applied. Any time their are differences between the partners the applicant and sponsor really have to go overboard to prove their genuine relationship to bypass the interview stage.

On May 13th I will win an appeal for my client who sponsored his wife. There were two basic reasons for refusal. His wife the applicant is 14 years younger. Sooooo!

His wife claimed her Long Haul Truck Driver husband makes 36 cents per mile. The Visa Officer tried to correct her by saying she must be mistaken and her husband should be making so much per kilometer. His wife stuck to the fact that he gets paid 36 cents per mile.

The Ministers Counsel argued and objected almost twenty times until the member raised his voice and said (TIME OUT). When Ford and GM advertise their cars milage do they advertise that their cars get 35 miles per gallon or 9 kilometers per litre. Well?

There is no use to not appeal and reapply because there will be no changes in circumstances from the first application. The Visa Post will only kick your wife for another interview and the different officer will not want to over rule her co-workers decison.

Do your due diligence in finding an experienced representative if your refused and the key word is (IF)your refused. You may still win.

If you have two or three hours google IAD Seminar then download VEOH and listen to a Toronto Hearings Officer and a IAD Member explaining to authorized representatives how to best represent their clients at spousal appeals.

Wait to hear back from CIC.

If your application is refused, look at the reasons of the refusal and you basically have two options:

1- You apply again and overcome the reason of the refusal.
2- Appeal the officer´s decision. You would have to prove the officer wrong with new or more evidence, otherwise your application would be refused again.

Depending on what the reason for the refusal is (if that is the case) you should hire a consultant to assist you with your appeal hearing.

Whether you go with one or not, it is up to you, if you do... get enough references and make sure that, that person is properly trained to handle these kind of cases.

Keep in mind that officers, rarely look at you as a person. You are a file number and their decision is based on the evidence that you have presented.

Like DocD and I said think positive you still may win.

If not don´t believe anyone that claims their spouse got into Canada in three months.

My advice has always been to think positive and hope for the best. Never to retain anyone unless they can prove their successes and will provide plenty of references!

Like DocD said your a file number and you can reapply but you have already been refused by their co-worker.

Wish you all the best.
