Subject: Australian with DUI charge in 2004
  Hi, I am an Australian citizen planning on a working trip to Canada in a few months. I was convicted of a DUI in August 2004 and lost my drivers license for 3 years. I have had no driving or other criminal charges before or since.
I recently went to Canada (Sept-Oct 2010) on a holiday and encountered no problems obtaining entry to the country. Will my conviction of 7 years ago show up on my passport check? Will it prevent me from obtaining a work visa? Will it prevent me from obtaining entry to Canada at all?? If so what are my options?

LMO approved or not, the applicants are required to submit their police certificate when applying for a work permit.

If your police certificate shows some record, you will have to take a step to be deemed criminally rehabilitated.

1. Apply for an ´Aussie´ pardon before applying for a work permit.

2. Apply for criminal rehabilitation at the Canadian visa office as a part of work permit process.

Welcome to the official Government of Canada website for the International Experience Canada - Working Holiday Program (IEC - WHP) for Australian passport holders. The WHP provides opportunities for young Australians to enjoy extended holidays in Canada and permits them to work for up to 24 months.

As from 02 January 2008, the WHP (for Australian passport holders) is no longer a ´once-in-a-lifetime opportunity´. Previous participants in the WHP (for Australian passport holders) may reapply as long as they meet the eligibility and admissibility criteria at the time of their new application.

This website provides information you will need to make your application to the Consulate General of Canada in Sydney. This is a secure site. Your personal information is protected and will only be used by the Government of Canada in order to process your application for Work Permit for the WHP Canada.

Applying to the WHP Canada is a two-phase process:

ONE: You will need to complete the online application process in order to self-assess your eligibility and admissibility. The application form and a customized checklist will be sent to your email account at the end of the online process. Your application form will have your unique participant number printed on it.

TWO: If you wish to proceed, you must then print the application form and submit it with required attachments to the Consulate General of Canada in Sydney.
Important Notice

December 2010 - The IEC - WHP policy will remain status quo in 2011. Re-applications are permitted as long as the eligibility and admissibility criteria are met at the time of the new application. The earliest a re-application may be mailed to our office is 12 weeks before your current working holiday work permit expires. Validity of the work permit will still be two (2) years. The is no quota or limit to the number of places given out per year.

September 2010 - There is now a requirement for all applicants to submit a Police Certificate with their WHP applications. In some cases, a traffic history record printout is also required. For details, refer to Obtaining Documents. Please note that you may need three weeks or longer to obtain these. Applications received by our office starting 1 September 2010 that do not include these requirements are considered incomplete and will be returned to the applicants.
