Subject: Tourist Visa-Urgent please help
  Greetings Folks,

I am 28 year old, Indian citizen, working in a public sector undertaking of India. I and my mate are planning to form civil partnership in canada, however we are not sure how we are gonna do this. We have only been chatting and making calls for past couple of months though. We have not met personally yet. However, we have decided to be of each others for rest of our lives. He´s a Canadian citizen and is in a low paid job. I have never traveled abroad yet. What possible options do we have? Although, we have gone through the entire immigration website (CIC),however,we´re afraid, haven´t been able to work this out for us.
As far as our knowledge is concerned, I can´t apply for Spousal visa or Communal Partner visa as of yet since we have to have been living together at least for a year, which we haven´t. So, we are considering for me to visit him for one month as tourist. Can we get married while I´m on TRV? Will it be legal and where will it lead us? After marriage there, can I seek extension of my TRV from there? We don´t want me to come back to India. Please please help us on urgent basis as I´m gonna apply for TRV from India.

Any help would so much be appreciated.

No - he can´t sponsor you as a spouse because you´re not common law or married.

Yes - you can get married in Canada if you are approved for a TRV and travel here.

Yes - you can apply to extent your TRV once you´re here.

Note that to be approved for a TRV, you will have to show strong ties to India (e.g. job, property, family, bank account, other assets) to prove that you will return to India once your trip is over and have no plans to stay in Canada long term. If you cannot demostrate strong ties to India, there´s a very strong change your TRV will be rejected. If that happens, your boyfriend will likely have to travel to India so that you can marry there.

Yea, I do know I´ve to show strong ties in India else my TRV will be rejected (since I am 28 year old and still single). But I do have a responsible job here in India and I do have dependent parents (who don´t live with me though, they do so in another Indian city), I have total savings of CAD 6000 only. I have an old car in my name (in another Indian city) used by my younger brother. I don´t have any other property. Will all these things prove my ties to India and will I be given TRV or not in your opinion?
Should I show that old car papers also as my property or that´s not required.

Me and my mate both are homos so if my TRV gets rejected , he can´t come here and marry me since here in India same sex marraige is totally null and not recognised in eyes of law :(

What we will have to do should that be the case?

If your TRV is rejected your partner should submit an application to sponsor you as a conjugal partner.

so, if my TRV gets rejected , my partner in Canada can sponosor me as a conjugal partner? How is that possible? What´re terms and conditions? Can he directly apply to sponsor me like that or for that TRV has to be rejected?

What conugal partner? They haven´t even met yet.

No free lunch here, your partner would have to move to India and live with you for a period of time then, he can submit a sponsorship and PR application, wait in line like everyone else and then you immigrate to Canada.

You want to get a turist visa to enter Canada and stay.

Even with a visa, what makes you think that you will be allowed entry into the country under your situation?

A visitor´s visa is to VISIT the country not to STAY. If your intentions are to stay in Canada , FOLLOW THE PROPER CHANNELS from abroad and wait in line LIKE EVERYONE ELSE.

Yes, but what if I get TRV approved and then marry my partner there?Thank you for your suggestions though.

Sorry - DocD is right. I didn´t read your original message clearly enough. Conjugal will only work if you have a "marrige like" relationship. Since you´ve never even met, conjugal won´t work for you.

You still have some options.

If you are approved for a TRV, then you can come to Canada and marry here. I agree with DocD that the chances of being approved are not in your favour. But this doesn´t mean you can´t try.

If you are not approved for a TRV, then your partner could move to India for a year and live with you to establish a common law relationship. Or if he can´t live with you for a full year - then live with you for most of the year to try to establish a conjugal relationship.

Yeah, very nice suggestion.

I´ll definitely apply for TRV.

However, it has to work because if it doesn´t, we will be no where.

My mate is in small job in Canada. Won´t be able to visit/live with me in India so frequently to establish a conjugal relationship.

What best should we do to ger TRV approved? In my second message on this post , I´ve mentioned about the funds I have. Will they be counted and I´ll be given TRV. What other options do we have?
