  Hey. I appreciate any help.


I was deported from Canada with my family when I was 14 years old. My parents who obviously made all the decisions for me and handled all the immigration issues did not comply with the removal, and we left on our own. Eventually, after so many years I now live in the US. I am now a U.S. citizen with a passport. Recently I was traveling to Niagara falls with a friend and wanted to visit the Canadian tourist area. Knowing of my past, I was a little hesitant at first, but I thought "you know its been 10 years". Obviously I still expected there to be a record of my family´s deportation, but what also made me decide to cross over the border was a desire to get my situation straightened out. Even if this meant getting turned away.

As I expected, I was taken in to the offices and they told me I had a warrant etc. I was arrested and deported within 2 hrs. They were nice and didn´t put any hand cuffs on, or detain me, and let me cross over the bridge on my own. The experience was not so stressful, but it was disappointing that even as a minor I had a warrant for an immigration violation I personally had no control over. Anyways, I was told to apply for authorization to Return to Canada. The officer told me that I should be able to receive it because I personally had never done anything illegal in Canada. Of course, this was just his opinion.


I have researched ARC cases over the internet to find something similar to my situation, but there were only 3 out there with no answers.

My question is as following:

What are the chances of me getting the authorization granted? Once again, I was 14 at the time, I am now a US citizen with no criminal record. My reason for wanting to return to Canada is tourism with my soon to be fiance, and visiting friends from childhood. I have nothing against Canada, it is basically where I grew up. I do not intend to live there in the near future as I am settled here in the States. I do not own any property here, but I serve in the Armed Forces, have a steady job, and am a Masters student.

Please provide any information that you can. To spend the 400 bucks would be worth it for me, because I love the recreation Canada has to offer. It is a beautiful place.

A decision on your admissibility can only be made when you apply to come to Canada or at a port of entry.

The link that Anonymous is sending you is regarding inadmissibility. Not really what you need at this point.

Now, I don´t think you were deported as per say. You were either excluded or refused of entry. Which one was it?

Did they give you a yellow form? Or the CBSA officer after asking a whole bunch of questions regarding your personal information just told you that at this point you cannot enter Canada and probably warned you about attempting to enter Canada again.

Which one was it?

A minor can not be held responsible for the actons of their parents and NO ARC is required! See ENF Manual

...I was arrested and deported within 2 hrs....I was told to apply for authorization to Return to Canada...

Well it depends. If the whole family was removed under A52(1), technically he is not responsable for his actions as a minor as Roy mentioned so no ARC rquired.

However under ENF A42(B) he can still be inadmissible based on an inadmissible family member.

It is hard to tell without seen what showed up in the screen during the inspection procedure. There might by a record that is still linking his name to the PDP database. (previous deported person).

This is one of those posts that never state the full picture!

Why would a minor have an arrest warrant if they were properly removed? Illogical - because confirmation of departure would have been recorded in FOSS.

I know certain individual CBSA staff makes mistakes but come on DocD do you swallow this logic.

Properly removed..BINGO! That is the million dolar question.

It is hard to answer without seen what it says in the screen during the inspection.

Yes maybe they left on their own but he said deported with his family!
