Subject: removal order?
  Hi,

I am in need of advice regarding my brother´s PRRA removal order, we arrived in Canada in 1995 and have been since rejected several times under the refugee applications, we have applied under H&C several times as well but due to lawyers and my mom not knowing the laws and being fooled by many was not aware of anything that happened to our file, then in 2003 i reapplied for H&C and since then my application was on hold for some reason. Mom, sister and i was recently approved as the applicant for landing under H&C and PRRA application put together. But my brother was not included because he was taken out of our H&C application with the suggestion of our lawyer because my brother was married and a separate sponsorship application in process. But due to reasons his marriage didn´t last and his application denied. At the time he received a PRRA application which we filed at the beginning of 2010 and recently he is being called at 6900 airport, i assume for the PRRA decision. I am not sure what should be my next step in helping him. Please also note that he does have some criminal charges such as under $500 FRAUD, DUI, and he was also arrested by immigration and was released on bail or bond, also please note when we arrived to Canada as a family we did not have any documents with us and we still haven´t gotten any except some Canadian documents that we received here. I know this is a very long but please help i don´t know where to turn.

Just wanted to correct myself, the charges he has are under $5000 fraud, DUI, and a lot of breeches.

He should have submitted his own H&C including a request to overcome his criminal inadmissibility as soon as his spousal sponsorship was denied and before he received a PRRA.

A negative PRRA decision is a virtual license to remove.

He is toast. There are three things here.

1- All I am hearing are poor excuses on why a person choose not to follow the law. That excuse is not going to get you anywhere. There is nothing you can do. He is a grown man, let him be.

2- Depending on what the outcome of the fraud thing is, he may or may not have to serve time in the can.

3- After the outcome of point#2, likely he will be detained, no more bails or bonds and he will be deported from Canada. He meets every single requirement to be removed.

He can go there on his own which may facilitate things for him. If he figures that is better not to show up then there will be a warrant against him and eventually he will be detained and removed.

The advice that Anonymous is telling you doesn´t make any sense. An H&C application in, will not prevent his deportation. His spousal application could have, but he´s not elegible based on criminal inadmissibility. PERIOD end of the story.

DocD: I am not giving excuses for his behavior, I appreciate your straight opinion and i wouldn´t have it any other way, but a little sympathy would do justice. I have asked for information and advice not to be squashed with what i already know.
