Overstayed in canada and going to get married

Subject: Overstayed in canada and going to get married
  I am Pietro and I´m Italian 24 year old. Just like my topic says I have overstayed 3 years my 90 days tourist visa. My canadian girlfriend and I are planning to get married soon, the question is, will I be able to change my status after we get married ??? I have never get caught while overstaying, and I don´t have any criminal records. Should I go back to my country with my gf and get marry there ??? Or can I get married here and change my status???


I really need some suggestions.

it is not just a matter of changing your status. Once you are married your wife will need to sponsor you. Even if you are currently visiting Canada, I would urge an Outland application.

Hopefully you will have sufficient photos over time which will show differences in hair style etc. that will show the length of your relationship or it growing. Either way you will need to come clean about overstaying and provide Police Clearance Certificates from Canada as well home.

Thanks Roy and Sharon for replying to my question..

Anyways, we should have more than enough pictures that prove our relationship, pictures not only taken in Canada but also at my home in Italy back in 2007. Those pictures show my parents and friends along with us, and yes all the pictures we have also show differences in hair
style, clothes, different places, people and seasons.

The fact is that I have overstayed here for 3 years, and the reason is because I really love my girlfriend, ever since the first day I met her. Unfortunately I´m not elegible to apply for a skilled working visa, neither I have ever found anyone willing to sponsorship. I could apply for a student visa to go to college, but to be frank I don´t come from a rich family, and I don´t see how I could afford to pay $13000 a year for tuition fee.

I know what I did is wrong, but if I only could change my status somehow I wouldn´t have ever overstayed...

Coming clean is admitting you overstayed.

Some renew their passports while in Canada which clearly shows they overstayed then lie about overstaying.

what is done is done. The only person that can sponsor you is your wife.

read the family class section of the www.cic.gc.ca website and focus on Outland application. You can apply outland even if you are sitting in Canada as a visitor.
