TRV rejection

Subject: TRV rejection
  My Mom applied for the TRV and rejected based on Regulation 179.

She has a house in Sri Lanka but not have large sums of money in the bank. However she is been supported by her children abroad with regular monthly funding.

What could be the reason? Could the decision can be re appealed right away?

The documents and completed application were given to:
TT Services Canadian application center
TT Services Lanka (Private) Ltd,
51A, Dharmapala Mawatha,
Colombo 07.

During the time of submission, they did not take the house deed copy - and I am wondering whether this was the only reason for officer to refuse the application?

Appreciate any assistance/feedback on this.

Your mother didn´t provide sufficient proof that she will return back home after her visit to Canada and this is why she was rejected. If she still wants to visit, she should reapply and provide proof showing strong ties to Sri Lanka.

She should certainly include the deed to her house when she re-applies. However there´s no way to know if this was the only reason for her rejection. Are all her children living outside of Sri Lanka? Does she still have a husband in Sri Lanka? What other strong ties to Sri Lanka can she show?

If she doesn not have a husband or other children in Sri Lanka and only has the one property - this may not be sufficient to overcome Regulation 179.

Thanks for the reply ´Anonymous´.

But my mother is a widow and unfortunately she don´t have anything else to show (Other than the house) to substantiate her claim.

Can she re approach as a follow up to her application status - directly through the High Commission in Colombo rather than going through the Out Sourced group TT Services?

If required as her son living in Canada - can I liaise with the High Commission?

Your mother can re-apply directly and doesn´t have to use an agent. To apply directly, she should follow the instructions here:

http://www.cic.gc.ca/english/visit/apply-how.asp

Since your mother doesn´t have many ties to Sri Lanka, it´s very possible that she will be refused a second time. You may have to visit her in Sri Lanka rather than having her come to Canada.

That would be very unfortunate.

If that is the case the next best thing will be is to sponsor her to Canada and have her spend the Winter in Sri Lanka as my mother is not interested in living in the winter weather conditions.

Now he question is - would the TRV rejection play a part on this process?

SHE IS NOT INTERESTED IN LIVING IN CANADA AS SHE IS MORE INDEPENDENT I SRI LANKA.

I know is it very hard to convince but that is the fact.

Opinions ? Suggestions?

A TRV rejection will not affect a PR application.

Note that processing times for parent PR applications are very long. Right now it takes approximately 88 months (i.e. more than 7 years) to complete the sponsorship processing for a parent from Sri Lanka.

THANKS FOR THE HEADS UP!!! 88 MONTHS - THAT´S A LIFETIME!!!

Then I have to look at the options for my mo of appealing this and re applying.

I KNOW THAT THIS WAS A PRIVILEGE WHICH HAVE BEEN MISUSED - AND BECAUSE OF THAT GENUINE PEOPLE ALSO HAVE TO PAY A PRICE.

One last question?

Can my mom re apply by handing over all the documents directly to the Canadian High Commission rather than going through the out sourcing group (TT Services)?

Or

Can I submit a TRV on behalf of her from here?

1- There is nothing to appeal. The officer´s decision in this situation is final.

2- She can re-apply directly, she doesn´t need to go through any agency.

She has to over come the reasons for the previous refusal, other wise, her visa will be refused again.

The whole idea of she visiting in summer is to make sure she doesn´t want to experience the cold weather and stay inside and immobile.
