Subject: Return after deportation possible?
  Hello, what are the chances for return to Canada if deported? My friend was deported at the end of June after being detained for about 7 months by CBSA for using a false identity when she filed for refugee then H&C but was arrested and detained prior to the decision. She lingered in detention for about 7 months before they finally got travel documents for her.

She still wants to come back to Canada after all of this and was wondering if she can go the spousal sponsorship route.

Factual answer would be most appreciated.

She needs to apply for an ARC in order to return to Canada. Wheter she gets it or not, it is up to the officer.

Lying wasn´t a good idea after all wasn´t it?

Absolutely not but what´s done is done.....So the ARC needs to be done before the spousal application or can they be done at the same time?

I thought there was a two year rule for ARC?

As an aside, if she decides to go the spousal sponsorship route, her application will very likely fall under heavy scrutiny due to MOC concerns. If she files under spousal, she should provide as much supporting documentation as possible to prove the relationship is really genuine.

Not worth her time to apply for an ARC not very deserving to go through the whole refugee process under a phony name.

Roy, its ok to be blunt, after all she did lie and now have to deal with the consequences of her action.

You said that its not worthwhile for her to apply for the ARC and I would agree however she asked me to find out so I´m just gathering some info for her.

Now, the ARC is it subjected to a two year rule or ??? Also should the ARC be submitted before the spousal or at the same time?

I would appreciate a response.
