Subject: Sponsoring my husdband's kid
  Hi,

My husdband and his daughter arrived last year from Africa. Now things aren´t going well between me and him. We´ve been separated for a month now. He told me that he wants to go back in Africa but his daughter will stay here to study. He is the father...I´m not the mother. I would really want her to go back with him. She is here because he was my husdband. She is 16 years old. Does he have the right to leave her here to I get to sponsor her for 10 years?

interesting question that I don´t think we have ever had on this forum before!

I am assuming he had to have a letter from the girls mother when she came to Canada. He has custody - not you. So, unless you legally adopted her, I am not sure if you are under any obligation. That said - should he abandon her in Canada, I am thinking the undertaking would kick in.

This is definitely a question for Doc or Roy. I am dying to hear the answer.

Did you sponsor the father and daughter? If so, then you signed an agreement to support them for a period of time after they landed and I believe you are bound by this agreement even if the father leaves the country.

Are you going to get to sponsor her?

Have you already sponsored her as a dependent child of your present husband?

Yes I signed an agreement to support them for a period of time. 2 years for him and 10 for her. But still wondering about the fact that if he leaves, do I still have to sponsor her? He´s the one who decided to leave the country. I can´t find any answer for a similar situation.

I am still hoping Roy will chime in.

In regular divorce law, I know a friend who married a woman with 2 kids from a previous relationship. They spit, but the courts required the non-biological father to pay child support because he took on the responsibility for the kids during the marriage.

Seemed rather bizarre at the time (as she was collecting child support from 2 men for the same kids) but this may very well end up being what happens in your case as well.

What you need is gentle persuasion or trick the girl to leave Canada with her father; if you want to continue to sponsor her, you may become her legal guardian once the Afro leaves. But these ppl must be animals to leave their offspring in a foreign country with a person they no longer are related to or respect!! But they are Afros so such things are to be expected. In any case, save up good cash, just in case the girl refuses to follow her dad.

Wowser, your racist remarks are not helpful. As a PR, this young girl can hop on a plane any time she wants and return to Canada. Think about it - free world class education and health care... I would probably want my child to have those opportunities too.

Question might be better - what exactly is Julie´s financial exposure/obligation and does the undertaking run the full 10 years even if the girl turns 19 or marries during that time.

Perhaps those Canadian men and women out there who are madly in love will look at this story and consider their decisions very carefully. It can happen to YOU.
