I am a canadina citizen , married to a non immigrant, to sponsor him, do i have to live in canada for a required time, I presently reside out of canada

Since you are a Canadian citizen, you do not have to be living in Canada to sponsor your spouse. However as part of the application, you must submit proof that you plan to return to Canada and make Canada your home once your spouse´s PR application has been approved.

PR and citizenship are two completely different things.

To obtain PR status for a spouse, a citizen can sponsor this spouse while both are living outside of the country. Once the application is approved, the spouse will come to Canada to "land" and officially become a permanent resident. If the spouse then wants to become a Canadian citizen (and not just remain a PR), they will qualify to apply for citizenship once they have physically lived in Canada for three out of four years.

To answer the second question, if a citizen sponsors a spouse while living outside of Canada, they must prove they plan to return to Canada and reestablish themselves there after their spouse obtains PR status by providing proof such as:

- job offer in Canada
- real estate owned in Canada
- rental agreement in Canada
- bank accounts in Canada
- any other evidence that proves they plan to live in Canada

Dear Orchid

Do not be lulled into believing that if you have a Canadian Bank account, that you own some Land,have a Provincial Drivers License, that creating a fake lease will prove that you have intentions to return to Canada.

The issue is how long have you been living abroad.

How are you supporting yourself while abroad?

If you own your own company what evidence is there that you can not stay abroad and run your business while out of Canada.

What reason where there that kept you abroad?

Orchid come back NOW and amend any application you sent in. Even your post strongly implies you have no intention on living in Canada and they and others will see right through your comments.

Hi , I come and visit, as my family is there, was just checking out the facts, if visitation was enough or we would have to live there permanently, if I intend to sponsor my husband then we will come as Canada requires, will come back , we are thinking about it. Thank you for your help. Will keep you posted.

Orchid, visiting family is not sufficient - you need to live in Canada.
