Subject: Sponsorship appeal
  !! My husband’s application for PR was refused in May 2011. |I believed that we had a solid application which included hundreds of e-mails, phone bills, and letters from friends, airline tickets, photographs, and details of our wedding. After my husband attended his interview he left feeling confidant t in how things went, they asked maybe 5 questions including how we met, how our relationship progressed. After getting the notes from the immigration officer I reviewed it with my husband and he informed me of things in the notes that were never said. The reason for refusal was that they thought my husband married me only for the purposes of immigrating to Canada. I am just looking for any advice on how to head into this whether it is in ADR or at a full hearing

It appears your husband was refused Regulation 4 because your husband did not prove both tests. They may believe it was a genuine marriage but they feel he was using you.

If you two had plans for the future they were not well explained!

No need to reapply because not much if anything has changed.

Understand they (CBSA & CIC) have something and you being so close to the situation can´t see what went wrong. You need someone who does appeals on a regular basis and can prove they win.

Shop around get references and ask to see decisions that the authorized representative is proud of.

If any Counsel is not able to show you decisions that they have won, RUN!

He did tell them that I felt our life would be better in Canada as I have a solid job with the government and that with us wanting to start a family I would need to see a specilist etc. I guess that was not enough for them I am going over to stay with him for 6 weeks as this whole process is quite emotional and I want to be with him. If they dont take this in to consideration then so be it, at least we have some quality time together. I´m praying that we get into the ADR

You´re driving in reverse!

I understand you wish to wake up with your partner every morning but if you want to do that in Canada by getting an Alternate Dispute Resolution hearing you need to create a submission package to clarify refusal reasons.

A few hours of happiness or a life time of happiness - your choice.

Stop sticking your head in the sand and fix the problem.

Hi how are you? My moms application was denied because my brother who was listed as a dependent now as a record. why does my brother record affect my moms application and he is over 18. What are my changes of being approved if I appeal?
