If your not a danger to the public and your identity is established the only other reason one can be detained by the Immigration Divisopn is that your likely to not show up for removal.
He turned himself in so.......
He gets released.

Violent Criminal but not charged in two years and how old are those convictions?
There is always two sides to the argument and the Immigration Division member did not hear sufficient evidence to find him a danger to the public.
