Subject: Likelihood of Interview
  Hello!

Would greatly appreciate a reply, please?

The quick details:

Outland, US to Canada, Spousal, Sponsorship part already approved.
Applicant out of status in Canada, unemployed. ("Simple" Overstay)
Extreme lack of money for the time being.

The application was sent completed, but the answers are short, to-the-point and factual. They do not specifically point to a particular ´proof´ in our pile of evidence. Very few photos, however evidence also shows American spouse having cards from Canadian´s benefits, insurances owned by both parties and beneficiaries of each other, power of attorneys for both medical and financial care.

Included was letter from bank showing joint bank account and joint rental lease of the apartment. There are other "proofs" as well but none as strong as the above. VERY large age difference, but apart from that from same type of background and education.

The applicant does not have any other inadmissibility issues.

The burning question(s):

If you do not mind, would you care to speculate on how likely an interview would be, please?
If the application was not done ´right to specs´ and we are declined, what steps would we most like to take after? (I know we´d like to appeal, but would at least need a link to start to look at that process)
Should we also be continuing to pursue pictures and other ´proofs´ for an interview?

Thank you, in advance, for your assistance. We also understand that there will be people that are (justifiably) not going to be very content at all that the applicant is an overstay. Understood and acknowledged. If the Canadian had had the money to renew or at least send the applicant back to the States it would have been done.

we are far more understanding than you think.

I would plan for an interview. Nothing lost but everything gained if you are prepared. You want to avoid the appeal so get it right the first time. In fact, you may as well get it together and send it.

Think of your application like a criminal case before a judge. You have all those questions - now... answer them with some proof. Assume they don´t believe you. I would even acknowledge that there is an age difference. Is this age difference culturally acceptable - if not... why does it not matter to you. Go to the CIC website and look at the procedural manuals for family class. It should give you insight in what their review criteria looks like.

CIC works from the premise that you are using the Canadian to secure permanent residency status. So tell them why not!

Thankful that you were so quick on the reply, and very grateful that your reply was not condemning. I realize that overstays happen far, far more than people may think. This does not make them right, and I am sensitive to that as well.

It appears then that more ´proof´ will need to be gathered. Is it wiser to wait for a potential interview call or to send in unrequested evidence? I have heard from others who have walked in these same shoes two different responses. One one hand, WE DO NOT WANT AN INTERVIEW. On the other, we certainly do not want to peeve off an already overworked Immigration Officer who may not want to view any further evidence.

Do understand that we are ever so thankful for your response, Sharon. I have read further on this site but by no means the entirety of it as yet. Your answers thus far have been short, sweet, and quite to the point. We will go to the CIC website to see the manuals. Forewarned is indeed Forearmed.

a peeved CIC officer is one that gets useless information or not enough information to be able to do their job. Think like a lawyer.

Also, check out the forum RoadtoCanada.com. There is a huge contingent of US/Canada inland and outland family class applicants that hang out there. Lots of good info.
