I finally won this Humanitarian and Compassionate application. These clients are so deserving.

Does it means that ALL refugees from China should be granted PR too since precedent is the basic principle established in all legal case when deciding subsequent cases with similar issues.

Congratulations!
The Chens have finally won their bid starting in 1997 through media saga and purchasing a condo and picketing for a show since Sept 2008.
It seems that what they will told on October 5th 2011 could be approval in principle. Another wait time expected?
Chinese saga has almost ended with Hong Zhang, Shu Fang, Wang and ChenZhangs. Congratulations!

Does it mean it sets a precedent NOT REALLY!
Well what it means is that when CBSA calls one in for results of PRRA and H&C that I know in advance.
It means that a client knows his authorized representative is the best and stays with that immigration Counsel for seven years because he knows his representative is the BEST!
It means that one particular client has unusual, undeserved and disproportionate hardship. That his particular representative (me) proved his case.
When one has a passion to show that CIC is wrong and the Client deserves compassion common sense will prevail.
It will mean that three Canadian children will be allowed to go to school, that three Canadian children will be allowed to marry when they reach the age of consent, that three Canadian children will not be taken from their parents and adopted out, that three Canadian children will be allowed to travel & it means that a 15 year old daughter in China will be allowed to hug her Dad FOR THE FIRST TIME IN M0RE THAN A DECADE. Do I feel terrific, Dah Yeah!!!!!!!!!!!!

Roy, how is your client different from the millions of other chinese refugees??? Most chinese are law abiding citizen (I am one by the way) and only wishes to have a better life in canada PERIOD.
The only problem is how do to accomodate such a large population - believe me when every chinese know that they can migrate via this method, ALL chinese are eligible. They will come here as refugee and have more children - if CIC refuse their refugee claim, they will cite your case as a precedent.
Please don´t attempt to explain why your case is different because it is not!!
Law has to be impartial, when you set a precedent, that means everyone from China who has more than 1 children will be eligible - do you agree?

I agree that any family outside of China with more than one child will have the possibility of being fined for above quota children.
In itself potentially facing a social maintenance fee is not enough to prove an H&C application.
This IRR from the IRB states a Professor from Alberta said they MAY not be fined. I wrote him and he claimed he never was referring to failed refugee claimants.
